DEED RESTRICTION/RESTRICTIVE COVENANT AGREEMENT AND
TEMPORARY EASEMENT FOR
LOTS 121, 123, 124, 126, 129, 130, 136 AND 137 OF
MOUNTAINGATE SECOND ADDITION
RECITALS

1. Alberts Development, LLC is the record owner of Lots 115 through 178 of
M.ountainGate Sec.ond Additi.on, Lane C.ounty Filing No. 2.007- 2.0<;';2-'-,
Recorded March ...:za., 2007, Lane County Deeds and Rec.ords.
2. Lots 121, 123, 124, 126, 129,130, 136 and 137 .of M.ountainGate Second
Additi.on (the Affected L.ots) have been identified as lots .on which slope repair
and fill replacement and privately engineered public improvement plan .
reconstruction w.ork needs to .occur prior t.o such lots being available for issuance
.of a Building Permit.
3. The City of Springfield, a municipalcorporati.on .of the State of Oregon, is
responsible for the approval .of the plat .of MountainGate Second Additi.on, but
wishes t.o assure that the Affected Lots shall n.ot be available f.or construction
until such time as all standards for final platting have been met, bonded or
otherwise guaranteed in accordance with Springfield Devel.opment C.ode Section
35.100 - Final Plat Requirements.
NOW THEREFORE, based upon the foregoing Recitals which are expressly made a part
.of this Deed Restriction/Restrictive Covenant Agreement Alberts Development, LLC
agrees to the foll.owing restricti.ons imposed uP.on the Affected Lots in M.ountainGate

1. Consideration. The c.onsiderati.on f.or this Deed Restricti.onjRestrictive Covenant
Agreement and Temporary Easement (The Agreement) is City approval of
MountainGate S,ec.ond Addition plat for rec.ordati.on at Lane County in acc.ordance

with Springfield Development C.ode Section 35.100 - Final Plat Requirements as
detailed below:
A. All slope repair and fill replacement work on the Affected Lots shall be
c.onstructed, inspected and approved in acc.ordance with approved Public
Improvement Plans and Permits #P30454 and KA Geotechnical Engineer
Rep.ort dated March 12, 2007 (the KA Report) as may be further modified
with City .of Springfield appr.oval.
B. All temporary measures necessary to acc.omplish work proposed by the KA
Report and generally depicted on Exhibit 1 (Olson & Morris C1-C2) shall be
removed, repaired .or reconstructed to all.ow f.or public and private
improvements suitable for typical residential c.onstruction.
C. This document shall c.onstitute a temp.orary easement upon the Affected Lots
for all constructi.on measures related t.o sl.ope repair and fill replacement work
described in A & B ab.ove. This easement is temporary and will terminate
uP.on Release in accordance with Secti.on 4, bel.ow.
D. Design and reconstruction of the permanent public water system for the
Affected L.ots has been c.ompleted and accepted by Springfield Utility Board
Water Department and Springfield Fire Marshal prior to the issuance .of any
B~i1ding Permit .or the imp.ort .of combustible materials .on the Affected Lots.
Fire access shall be maintained at all times in accordance with temporary and
permanent fire pr.otecti.on plans approved by the City of Springfield.
2. Peroetual. Until such time as the Restriction is removed by the City of
Springfield pursuant t.o Paragraph 4 below, this Restricti.on shall be perpetual and
shall run with the land and shall be binding upon Alberts Devel.opment, LLC and
its heirs, success.ors, and assigns.
3. ADolicabilitv. N.o Building Permit Applicati.on shall be accepted by the City .of
Springfield for the Affected L.ots until the City .of Springfield has determined that
all sl.ope repair and fill replacement w.ork described in the KA Rep.ort, as may be
further modified with City of Springfield approval, has been c.ompleted for such
lots, and the public water system described in Section 1D has been tested and
. accepted by Springfield Utility B.oard Water Department and the City .of
Springfield Fire Marshal.
4. Release. Up.on satisfact.ory c.ompleti.on .of the requirements set f.orth in
Paragraph 3 above as determined by the City Engineer, alll.ots shall be released
from this Agreement. The City of Springfield will prepare, execute and record a
release from this Deed Restrieti.onjRestrictive C.ovenant Agreement. Filing fees
f.or said Release Document shall be paid by Alberts. .

5. Transfer. Up.on recordation of final plat all affected I.ots may be transferred; sold
or conveyed, Provided H.owever, such conveyance shall be subject to the terms
and conditi.ons .of this Deed Restricti.onjRestrictive C.ovenant Agreement.
