ORDINANCE No. 6113 (General) AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD AMENDING Article 1, "SPRINGFIELD BUILDING CODE ADMINISTRATIVE CODE" OF THE SPRINGFIELD DEVELOPMENT SERVICES DEPARTMENT; COMMUNITY SERVICES DIVISION" BUILDING SAFETY CODES AND DECLARING AN EMERGENCY. WHEREAS, the Building Safety Codes specifies that rates, permit fees, license fees, and other fees and charges are adopted by Ordinance of the Common Council; and WHEREAS, the opportunity for public comment at a public hearing has been provided prior to the adoption of this Ordinance; and WHEREAS, the proposed Building Safety Code sets forth all rates, permit fees, license fees, and other fees. WHEREAS, it is proposed to modify certain rates, permit fees, license fees, and other fees . set forth in Tables 3-A, 3-B, and 3-F which are increased or modified as specified below. . WHEREAS, in Table 3-A, the 2002 ICBO Standards Valuation Table has been retained, together with using the Consumer Price Index from the prior year; and in Table 3-B, in section (a) electrical labels a $50 fee has been specified; and Table 3-F, in section (i) an adjustment to the temporary occupancy table and fee has been specified for remodels of commercial/industrial buildings and new commercial/industrial buildings. NOW THEREFORE, THE CITY OF SPRINGFIELD CITY COUNCIL DOES ORDAIN AS FOLLOWS: Section 1: The fees specified in Tables 3-A, 3-B, and 3-F of Article 1, Building Safety Code, attached hereto and incorporated herein by reference are hereby adopted and made a part of Article 1, Building Safety Code: Section 2: In the event a particular rate, permit fee, license fee, or other fee or charge previously adopted in the Building Safety Codes or by Ordinance has been inadvertently omitted from those designated in Article 1 attached hereto and incorporated herein by reference, such rate permit fee, license fee or other fee or charge shall be deemed to be included and incorporated into this Ordinance and adopted herein by reference. It is the intent of this Ordinance to reestablish all such omitted fees and charges at the amounts that they existed immediately prior to this Ordinance. Section 3: If any particular rate, permit fee, license fee, and other fee or charge should be held invalid by operation of law or any court of competent jurisdiction of the enforcement of any fee restrained by such court pending the final determination as to its validity, the remainder of the rates, permit fees, license fees, fees and charges specified in the Building Safety Codes, Article I, shall not be affected thereby and shall remain in full force and effect. . Attachment B 1 . Section 4: Future Ordinances of the Common Council may be adopted to amend, add, or delete any rate, permit fee, license fee, or other fee or charge. Section 5: It is hereby found and determined that matters relating to the imposition of Building Safety Code fees are matters affecting the public health, safety, and welfare and that this Ordinance shall take effect on 19TH of January 2005.
