NOTE: This Inf.ormation Notice 1.0 Property Owners Ab.out Construction ResP.onsibilities was developed by the Construction Contractors B.oard in accordance with ORS 701.055(5), passed by the 1989 Oregon Legislature. If you are acting as your own c.ontract.or to construct a new home .or make a substantial improvement t.o an existing structure, you can prevent many pr.oblems by being aware of the following resP.onsibilities and areas of c.oncern. EMPLOYER RESPONSIBILITIES: If y.oU hire pers.ons n.ot registered with the C.onstructi.on C.ontractors B.oard to d.o lab.or in <;.onstructing or assisting in the construction or improvement of a residenlial structure, y.oU will. in most inslances, be ruled t.o be an "employer" and the people y.oU hire will be "empl.oyees". As the empl.oyer, you must comply with the following: Oreg.on's Withh.olding Tax Law: As an empl.oyer, y.oU must withh.old income taxes from employee wages at the time employees are pa~d. You will be liable f.or the tax payments even if y.oU don't actually withhold the tax fr.om your employees. For m.ore inf.ormation, call the Oreg.on Department .of Revenue at 378-3390. Unempl.oyment Insurance Tax: As an empl.oyer, y.oU are required t.o pay a tax for unemployment insurance purp.oses .on the wages of all empl.oyees. F.or m.ore inf.ormati.on, call the Oreg.on Empl.oyment Division DHR at 378-3224. W.orkers' C.ompensation Insurance: As an employer, you are subject to the Oregon W.orkers' Compensati.on Law, and must .obtain workers' c.ompensation insurance for y.our employees. If y.oU fail to .obtain w.orkers' c.ompensati.on insurance. you may be subject t.o penalties and will be liable for all claim costs if one of y.our employees is injured on the job. Liability and Pr.operty Damage Insurance: Contact y.ourinsurance agent to see if y.oU have adequate insurance c.overage f.or accidents and omissions such as falling t.ools, paint overspray, water damage from pipe punc- tures, fire, .or w.ork thaI must be re-done. Time t.o Supervise Employees: Make sure y.oU have sufficient time to supervise your empl.oyees. Expertise: Make sure you have the expertise t.o act as y.our .own general contractor, to c.oordinate the work of rough-in and finish trades, and to n.otify building .officials at the appropriate times S.o they can perform the required inspections.
