Staff Decision: Preliminary Approval with conditions - see below.
Findinas of Fact
Reauest
The request is for a Lot Line Adjustment to reduce the size of Tax Lot 2300 and to
increase the size of Tax Lot 2200, Assessor's Map 17-03-22-00, so that the Tax Lot
2300 consists of the entire property to be sold to Target Stores.
Backaround
In 1988, the City granted approval for a shopping center consisting of nearly 70
acres on three lots (Jo. No. 88-03-35). The development site consists of Tax Lots
2200, 2300 and 2109 all owned by Gateway Mall Limited Partnership. In October 1989,
the City approved a Lot Line Adjustment application (Journal No. 89-10-172). This is
a resubmittal of that application which expired without receiving Final Approval
within the required 90 day period.
Currently Tax Lot 2300 contains approximately 20 acres and Tax Lot 2200,
approximately 38 acres. The existing shopping center covers portions of Tax Lots
2200 and 2300. Upon approval of this request, Tax Lot 2300 will contain
approximately 8.67 acres and Tax Lot 2200 approximately 49 acres.
Criteria of Aooroval (Ref. Section 33.040 of the Springfield Development Code)
The lot line adjustment does not:
1. Create a new lot or land-locked parcel;
No new lot or land-locked parcel is proposed to be created. Two lots existed
prior to this application; two lots will exist upon approval of this
application. Both lots will have direct access to public right-of-way.

. in the Metro Plan. The minimum lot size in commercial districts is 6,000 square
feet. The increased size of Tax Lot 2200 and the reduced size of Tax Lot 2300
far exceed the minimum lot size standard for commercial districts. Approval of
this request will not violate the standards of the Springfield Development Code,
or Structural Specialty and Fire and Life Safety Code standards.
3. Impede the implementation of adopted transportation or public facilities plans;

This request will not impede the implementation of adopted transportation or
public facilities plans. Access to Gateway Street and Harlow Road can occur
through the existing driveways approved through the Site Plan Review process in
1988. A joint use/access and maintenance agreement will be required within 10
days of closing with Target Stores. The terms of the Development Agreement
signed with General Growth as part of Jo. No. 88-03-35 will be in effect until
the joint use agreement is received by the City.
4. Violate any previous requirements or conditions the Approval Authority may have
imposed at a prior public hearing or meeting.
This application does not violate previous requirements or conditions the
Approval Authority imposed at a prior public hearing or meeting. However,
Rainbow Water District requested 12 foot easements for water facilities on the
mall site (see attached letter). These easements will be a condition of
approval 'of this request. The easements must be shown on the survey.
Decision
Since the request complies with the criteria of approval, as conditioned, the
proposed Lot Line adjustment will be granted Preliminary Aooroval.
The Springfield Development Code requires that a surveyor be hired to set new
property pins and create new legal descriptions. When the conditions listed below
has been met, Final Aporoval will be granted. Preliminary Approval expires 90 days
from the date of this letter.
Conditions
1. Two copies of a survey showing points set.
2. The fee for recording a Notice of Bancroft Assessment Lien - $50.00 payable to
the City of Springfield (Note: This condition has already been met).
3. Copies of recorded easements for Rainbow Water District.

Additional Information Reauired
A copy of a recorded joint use/assess and maintenance agreement for Tax Lot 1900 and
Tax Lot 2000 as soon as possible after closing with Target Stores (Note: This is not
a condition of approval).
Anneal
An appeal of this decision may be filed by an affected party with the Development
Services Department within 10 calendar days of the date of this letter (Ref. Article
15 of the Springfield Development Code). Any action taken pursuant to Development
Approval before the 10 day appeal period has elapsed shall be solely at the
applicant's risk.
Additional Information
The City does not record lot line adjustment maps. Therefore, you should request
that the Lane County Department of Assessment and Taxation combine the property being
transferred into the same tax lot as the recipient lot. The recipient lot should
then be considered as a consolidated single land unit for tax purposes.
