CITY OF SPRINGFIELD, OREGON
RESOLUTION NO. 06-48
A RESOLUTION AUTHORIZING THE CITY MANAGER TO A WARD COMPETITIVE BIDS
AMOUNTING TO MORE THAN $35,000 AND APPROVE AMENDMENTS TO PUBLIC
CONTRACTS DURING THE PERIOD OF DECEMBER 5, 2006 THROUGH JANUARY 2, 2007
WHILE THE CITY COUNCIL IS IN RECESS.
WHEREAS, Chapter 2, Section 2.706, "PURCHASING," of the City of Springfield Municipal
Code limits the City Manager's authority to make purchases and award contracts to amounts of $35,000
or less, (2.706(2)(c)) and prohibits amendments to public contracts where the amendment cost exceeds
certain limits imposed by the Code except in the case of Council approval (2.706(3)); and,
WHEREAS, the Common Council will be on recess from December 5, 2006 through January 2,
2007; and,
WHEREAS, delaying these purchases and agreement approvals until the January 8, 2007 Council
meeting would interrupt critical timelines, increase the City's exposure and might raise costs and reduce
public service; and,
WHEREAS, there may occur the need to execute contracts which have been competitively bid
for which funds have been budgeted, and for which the lowest responsible bid is in excess of $35,000 or
which need to be amended, and which for reasons of public welfare, safety, and cost effectiveness need
to be awarded or amended during the Council's holiday recess from December 5, 2006 through January
2, 2007.
NOW THEREFORE BE IT RESOLVED, by the Common Council of the City of Springfield as
follows:
1. During the Common Council recess from December 5, 2006 through January 2, 2007, the City
Manager is hereby authorized to award competitive bid contracts for amounts for which the
lowest responsible bid is in excess of $35,000, (2.706(2)(c), and to approve amendments to
public contracts where the amendment cost exceeds certain limits imposed by Section 2.706(3)
of the Springfield Municipal Code, except in cases of City Council approval, including, but not
limited to contracts which have been competitively bid, for which funds have been budgeted, and
which for reasons of public welfare, safety, and cost effectiveness need to be awarded during the
Council's holiday recess, including but not limited to those contracts set forth on the attached
anticipated Project/Contract Summary, provided all other applicable purchasing requirements in
the Springfield Municipal Code are followed.
2. This Resolution shall take effect on December 5, 2006 and shall lapse on January 3, 2007.
Adopted by the Common Council and approved by the Mayor of the City of Springfield, Oregon
this fourth day of December 2006, adopted by a vote of ~ for and ~ against.
