ORDINANCE # 6161
AN ORDINANCE AUTHORIZING THE CITY MANAGER AND THE COUNCIL
TO OFFER REWARDS IN CONNECTION WITH DAMAGE TO CITY
PROPERTY, AND ADDING SECTIONS 5.800 THROUGH 5.808
TO THE SPRINGFIELD MUNICIPAL CODE
THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD DOES ORDAIN
AS FOLLOWS:
Section 1. Chapter Two of the Springfield Municipal Code, as amended, is further
amended by adding thereto, as sections 5.800 through 5.808, the following:
5.800 Offer of Reward. In the case of any damage to the property of the city,
including but not limited to trees, shrubs, plant life, and other landscaping, the city
manager may offer a reward, not to exceed $1,000, for information leading to the
apprehension and conviction of any person responsible for causing such damage.
5.802 Additional Reward. In addition to the reward authorized by Section 5.800,
the Council may, by resolution, authorize the offer of a reward of such greater amount as
it shall deem appropriate to encourage apprehension and conviction of the party
responsible for causing damage to the property of the City.
5.804 Limitation of Reward. Any reward shall not apply to any city employee,
nor any other officer of the city, country or state who makes such arrest or furnishes
information or assistance in the discharge of their official duties.
5.806 Conflicting Claims If conflicting claims are made for any reward offered
by the city under this provision, the city shall be discharged from all liability on paying
such reward into the municipal court, which shall finally determine such claims.
5.808 Authority to order repayment of reward. (1) In addition to any other
sentence it may impose as a result of a criminal conviction, the municipal court may
order that a defendant reimburse any money paid to a person, organization, association or
public body or officer, any sum or portion thereof offered and paid by under this article,
as a reward for information leading to the apprehension of the defendant. Reimbursement
under this section shall be ordered paid into the court, for further transfer by the clerk to
the City. The monetary obligation described in this section is a category 4 obligation
under ORS 137.295.
(2) In determining whether to order reimbursement under this section, the court shall
take into account:
(a) The financial resources of the defendant and the burden that reimbursement
will impose, with due regard to the other obligations of the defendant; and
(b) The ability of the defendant to make reimbursement on an installment basis or
on other conditions to be fixed by the court.

Section 2. Should any court of competent jurisdiction determine that a section or part
of a section of this ordinance is invalid, such invalidity shall not impair the effect or
validity of the remaining sections or parts of sections, which shall remain in full force an
effect.
Section 3. This ordinance shall become effective as specified in Springfield
Municipal Code Section 2.110.
