ORDINANCE NO. 6173 (General)
AN ORDINANCE AMENDING THE SPRINGFIELD MUNICIPAL CODE (SMC) SECTION 5,
PUBLIC PROTECTION, SPECIFICALLY SMC 5.286, "POSSESSION OF FIREARMS
PROHIBITED," BY DELETING A PORTION OF SMC 5.286, AND ADDING 'LOADED" TO
THE CAPTION TO BRING THIS SECTION OF THE SPRINGFIELD MUNICIPAL CODE
INTO COMPLIANCE WITH STATE LAW AND DECLARING AN EMERGENCY
The City Council of the City of Springfield finds as follows:
1. It is in the public interest for the City of Springfield to amend SMC 5.286 to bring this
section of the SMC into compliance with State of Oregon law, specifically Oregon Revised
Statute (ORS) 166.173.
NOW THEREFORE, based upon the foregoing findings, the City Council of the City of Springfield
ordains as follows:
Section 1. Section 5.286, "Possession of Firearms Prohibited," of the Springfield Municipal
Code, is hereby deleted in part to read as follows:
"5.286 Possession of Loaded Firearms Prohibited.
Except as provided in ORS 166.173(2), it shall be unlawful for any person to possess any
loaded: firearm, rifle, shotgun, revolver, pistol, air gun, air rifle or any similar
mechanism by whatever name known which is designed to expel a projectile through a
gun barrel by the action of any explosive powder, gas, compressed air, spring or elastic
mechanism at any public park and recreation district facility open to or frequented by
the public, including but not limited to, parks, roads, buildings, and parking lots. This
prohibition shall not apply to activities sponsored or authorized by a park district. The
above offense is punishable as a violation and subject to a fine not exceeding $720.00
pursuant to SMC Section 1.205."
Section 2: Matters relating to the possession of loaded firearms are matters of health, safety
and welfare; and therefore an emergency is declared to exist and therefore this Ordinance shall
take effect upon adoption by the Council and approval by the Mayor
Adopted by the City Council of the City of Springfield this 15thdayof May
a vote of ----L- in favor -L against.
