ORDINANCE NO. 6171 (General)
AN ORDINANCE AMENDING CHAPTER 6, VEHICLES AND TRAFFIC, DELETING
SECTION 6.070 AND ADDING SECTION 6.560 OF THE SPRINGFIELD
MUNICIPAL CODE SO AS TO PROVIDE THAT THE PENALTY SECTION OF
CHAPTER 6 APPLIES TO THE ENTIRE CHAPTER 6.
The City Council of the City of Springfield finds as follows:
1. It is in the public interest for the City of Springfield to delete Section 6.070,
Penalties, from the Springfield Municipal Code.
2. It is in the public interest for the City of Springfield to add a new section to the
Springfield Municipal Code to follow Section 6.555 as Section 6.560.
3. It is in the public interest for the City of Springfield to delete Section 6.070 and
add the new Section 6.560 so that the penalty section applies to the entire
vehicle and traffic Chapter 6 of the Springfield Municipal Code.
NOW THEREFORE, based upon the foregoing findings, the City Council of the City of
Springfield ordains as follows:
. Section 1. Section 6.070 of the Springfield Municipal Code is deleted.
Section 2. The following language shall be added to Chapter 6, Vehicles and Traffic
index page:
"6.560 Penalties."
Section 3. The following language shall be added as Section 6.560, Penalties:
"6.560 Penalties. The fine for violation of any provision of sections 6.005 to
6.555 shall not exceed $500. The proceedings shall be civil in nature. The
owner shall also be responsible for expenses incurred in removing the vehicle.
Failure to pay accrued charges shall constitute a surrender of the vehicle to the
city or authorized police garage to dispose of in accordance with this code and
Oregon Revised Statutes." '
Section 4. Severability. If any phrase, clause, or other part or parts of this Article is
found to be invalid by a court of competent jurisdiction, the remaining phrases, clauses
and other part or parts shall remain in full force and effect.
