ORDINANCE NO. 6165 (General)

AN ORDINANCE AMENDING THE SPRINGFIELD MUNICIPAL CODE (SMC) SECTION 5, PUBLIC
PROTECTION, TO ADOPT BY REFERENCE PORTIONS OF OREGON REVISED STATUTES (ORS
CHAPTER 153) THEREBY ADOPTING STATE ENFORCEMENT PROCEDURES FOR VIOLATIONS.
The City Council of the City of Springfield finds as follows:
1. It is in the public interest for the City of Springfield to adopt portions of ORS Chapter
153 so that the Springfield Municipal Code provides enforcement procedures for
processing violations; and,
2. It is in the public interest for the City of Springfield to adopt ORS Chapter 153,
Sections 153.005 through 153.161, to allow the Springfield Municipal Court a
codified system for processing of "violations."
NOW THEREFORE, based upon the foregoing findings, the City Council of the City of Springfield
ordains as follows:
Section 1. A new section will be added to Section 5, "Public Protection" of the Springfield
Municipal Code. The new section will follow SMC Section 714 and begin with the number
715 and be titled:
"5.715 Enforcement Procedures for Violations"
. Section 2. There is hereby added to Chapter 5, "Public Protection" of the Springfield
Municipal Code, a new Section 5.715 as follows:
"5.715 Enforcement Procedures for Violations The City of Springfield adopts and
incorporates by reference herein the Oregon Revised Statutes regarding procedures for
processing violations as described in ORS Chapter 153, Sections 153.005-153.161.
Therefore, the Springfield Municipal Code hereby authorizes City of Springfield employees to
process violations pursuant to state law per the above listed sections."
Section 3. Severability. If any phrase, clause, or other part or parts of this Article is found
to be invalid by a court of competent jurisdiction, the remaining phrases, clauses, and other
part or parts shall remain in full force and effect.
Adopted by the City Council of the City of Springfield this 15th day of May
