VARIANCE REQUEST: Front yard setbacks for carports/garages in the low density
Residential District.
CITY REFERENCE: 3.05 F. of the Springfield Zoning Code
At the Board of Appeals.meeting held on January 12, 1984, the Board of Appeals
,rendered the following decision regarding the above referenced variance request:
XX Approved
, FINDINGS OF FACT:
1. The request meets the intent of the Code, i.e., the purpose of the 20' setback
I for carports/garages is to allow for the parking of a vehicle so that it
does not encroach into the sidewalk area. Because of the manner in which
the street was paved (the 26' of right of way between the property line and
the northerly curb)"if the street were widened to the normal 36' paving
width plus 5' to 7' for sidewalk, enough right of way exists to provide for
the necessary 20' between the garage and the sidewalk.
2. Given the above conditions, the granting of the variance will not .adversely
affect public safety. '
SPECIAL CONDITIONS
Vision clearance on the west side of the property must be maintained.
