SUBJECT: Use of 1655 Diamond Street as a Child Care Facility
Dear Mrs. Gambee:
As you are aware, the City's Hearings Official approved (with conditions) the
use of 1655 Diamond Street as a Chil~ care facility. Before this use may
commence all condltlons required by the Hearings Official and all Code
standardS applicable to this use must be satisfied. I have prepared the
following list of these conditions and standards so that you may proceed with
your plans.
The Hearings Official requires:
1. The facility be limited to the service of 29 or fewer children of age five
or younger per day. (This condition is intended to ensure conformity with
the requirements of SDC 2.020 and it is the intent of the Hearings
Official that any lessening of the age restrictions of this Code proviSion
shall oe automatically applied to this application.) Hours of operation
shall be limited to,9:00 a.m. through 3:00 p.m. during weekdays.
2. Prior to the utilization of the property for reSidential uses during the
operatlon of the child care facility, a parking site plan, which meets the
requl rements of SDC 31.090, sha 11 be approved by the Di rector.
This plan shall oe submitted and approved through the Type I review
process and taKes approximately 15 days. See Section 3.070 of the SDC.
3. Prior to the operation of the child care facility, the applicant must
either receive approval from the County Sanitarian for the operation of
the existing subsurface sewage disposal system or hook up to the
Springfield sanitary sewer system.
Connection to the city sewer requires annexation or an extra territorial
extension of urban services. Either action requires puolic hearings
before the Planning Commission, City Council and Boundary Commission.

A letter from the County Sanitarian shall be suDmitted to the Springfield
Planning & Development Department to verify the status of the septic tank
if it is approved for the proposed use. If the existing septic tank is
found to be inadequate tne operation of the child care facillty shall not
commence until the actual connection to the sanitary sewer system is
complete and has been inspected and approved.
4. After one year from this decision, the Director shall investigate whether
the child care facility has produced substantial noise impacts upon the
adjacent and surrounding neighborhood. If such a finding is made, the
Hearings Official shall reopen this site plan approval on the issue of the
mitigation of noise.
The Planning & Development Director shall maKe his determlnation upon any
complaints received from neighboring property owners.
The Springfield Development COde requires:
1. The signing of a contractual annexation agreement prior to the utilization
of the p~operty as a child care facility.
2. The signing or a Development Agreement prior to the utilization of the
property as a child care facility.
Upon verification from the County Sanitarian that the existing septic
system can accommodate the proposed use, and upon resolution of the
annexation issue, a Development Agreement shall be prepared in accordance
with Section 31.090 of the SDC.
3. A Final Site Plan shall be suomitted within 90 days of the final decision
of the Hearings Official (August 13, 1987). Condition #2 of the Hearings
Officlal decislon shall be included in tne Final Site Plan.
Planning & Development Director Greg Winterowd has been informed that you are
presently using this property as a Chlld care facility. He apologlzes if the
process was unclear, however, all formal procedures must be completed before
thlS property can oe used as a child care facility.
