Dear Mr. & Mrs. Wyatt:
As I indicated on ~he phone, we have reached a settle-
ment in the above-entitled matter which involves the payment of
$1,000 to the McElvains.In return, the McElvains ,will dismiss
the lawsuit against you and will sign a release releasing you from
all claims arising out of the construction of your house. The
release will make it clear that this is a compromise settlement of
a doubtful claim and is not to be construed as an admission on
your part of any liability or fault.

As I explained to Mrs. Wyatt, this settlement will not
protect you from future lawsuits brought by.. the McElvains if you
should do something to damage their property in the future. However,
our investigation strongly showed that the McElvains' property has
always been subject to standing water and that the construction'of
your house did ,not adversely affect that condition. In addition"
as you can see from the enclosed copy of the engineer's report,
the standing water condition can be removed by the McElvains for
a relatively small amount of money by placing a drain to the street.
In spite of the fact that the McElvains made such a big deal about
the water, I doubt that they will ever spend the money to correct
the problem. In any event, this is a very favorable settlement and
we are happy to have been able to avoid 'the cost of trial for so
little. I have enclosed a copy of the release for your information.

I have investigated site conditions ,made contact with the Springfield Public Works
Department and prepared a recommended drainage installation for these properties in
order to alleviate the standing water conditions as you had requested. The attached
drawing indicates the proposed installation. I have obtained a cost for these install-
ations from Robert Storrs of Perrco/Storrs Company as follows: '
$1,450 if work must be done during wet season.

$1,150 if this can be done in dryer' weather.
':: '::~ Tbe installation cost is higher than I expected because the storm sewer stub installed
':\;:";'by the City is located adjacent to the driveway. This requires that the drain line
.:;j'@";1>e', installed between the driveway and the fence line which is a confined space and
'- ~" "will require mostly. hand digging. As you will recall, we had anticipated that the
sewer connection was on-the east side where there is room for a backhoe.
Please excuse the delay in getting this to you. The reason is I had difficulty in
getting a proposal from a contractor since they were busy, during the December rains
and not available during the Holiday Season.
