HomeMy WebLinkAboutOrdinance 6215 02/04/2008 ORDINANCE NO. 6215 (General) AN ORDINANCE AMENDING SPRINGFIELD MUNICIPAL CODE (SMC) 5.402, DEFINITIONS REGARDING BARKING DOG, AND 5.420, BARKING DOGS PROHIBITED VIOLATION. The Common Council of the City of Springfield finds as follows: A. It is in the public interest for the City of Springfield to amend SMC 5.402, Definitions whereby revising the City of Springfield's definition of "Barking Dog" by adding the new definition of "continuous annoyance." B. It is in the public interest for the City of Springfield to amend the above described section so as to provide clearer language to City employees and the general public regarding barking dogs and violations of SMC 5.420 due to barking dog incidents. NOW THEREFORE, based upon the foregoing findings, the City Council of the City of Springfield ordains as follows: Section 1. Springfield Municipal Code Section 5.402 is hereby amended to read as follows: "Section 5.402 Barking Dog, Continuous Annoyance. For purposes of violation of SMC Section 5.420; permitting a barking dog to cause continuous annoyance occurs when: a person unreasonably permits a dog to cause continuous annoyance, alarm or disturbance for more than 15 minutes at anytime of day or night, be it repeated barking, whining, howling or other like sounds which can be heard beyond the boundary of the owner's property." Section 2. Springfield Municipal Code Section 5.420 is hereby amended to read as follows: "Section 5.420 Barking Dogs/Continuous Annoyance. No person shall unreasonably permit a dog to cause continuous annoyance as defined in Section 5.402. The above offense is also punishable as a violation and may include a fine not exceeding $720.00 pursuant to SMC section 1.205." Adopted by the Common Council of the City of Springfield this 4thdayof February ,2008, by a vote of 5 in favor 0 against.
