,',.' During an Occupancy Inspection at the above referenced address, a question arose
. .;.:...',:"., relative to the extent of the changes that would (or should) be required in
': order to change a single family residence into ~n office use. More specif-
ically, the Oregon State Structural Code and Fire and Life Safety Code (S.S.C.)
specifies that exterior walls relative to office uses located closer than
twenty feet from a property line shall be of one-hour fire resistive construc-
tion. The S.S.C. also states that openings within such walls shall be pro-
tected (i.e., fire rated assemblies) when located closer than 10 feet to a
property line.

On the other hand, there is a provision of the S.S.C.that allows the Building
Official to approve a change of use without requiring the new use to meet all
of the requirements of the code, provided the new use is thought to be less
, .' hazardous, based on life and fire risk, than the existing use. ,..' '."

For a variety of reasons - no cooking, sleeping, etc. - I am of the opinion
" that at least some small office uses are indeed less hazardous~ or at least no
more hazardous, than residential uses. Using the property at 1170 Custom Way
as an example, I asked the Building Board of Appeals if they agreed with my
opinion on this matter. They agreed.:As a result, the requirements for fire-
resistive exterior walls and protected openings have been waived.,..",:.. ,. ,,:
