Re: Discretionary Use approval for retail sales in the Low Density Residential
District
Thank you for your letter dated June 25, 1991. I Have spoken to Greg Mott,
Planning Division Manager, concerning this issue.
Your residence, located at 4472 Daisy Street, is zoned Low Density Residential;
the East Main Refinement Plan designation is Low Density Residential; the Metro
Plan Designation is Low Density Residential. There is no commercially zoned or
designated land nearby (the nearest commercial uses are along Main Street).
A Discretionary Use application (Springfield's terminology for a Conditional
Use Permit) requires approval from the Planning Commission and there is a
$250.00 non-refundable fee required to be paid by the applicant. Discretionary
Use concerns the appropriateness and compatibility of uses. Staff cannot
support a Discretionary Use application allowing retail sales in the Low
Density Residential District because staff contends the criteria of approval
cannot be met.
You may store your boats and other equipment on your property if the boats and
other outside storage are behind a sight obscuring fence. However, no sales
may occur.
If you want to have a repair business as a home occupation, you must contact
Kent Kullby at 726-3660. If you do not currently have a permit, you must
obtain a permit by paying a one-time $25.00 fee. You should know that SDC
16.100(6)(c)8. states: "No merchandise other than what is produced on-site
shall be sold to the public from the premises."

Dear Mr. Karp:
From the time our house was built and we moved into it in 1971,
we have done outboard motor repair at that location.
During the winter of 1984-85, in order to obtain parts for a
particular brand of motor and in order to provide an economical
product to the public, we contracted for the dealership of Eska
outboard motors. In January of 1985, we started stocking a small
inventory of those motors. We continued doing outboard motor
repair.
In August of 1985, we were notified that we had to cease retail
sales. Until that time, we had been unaware that retail sales
were prohibited at a residence. We were informed then that the
only tille the code against retail sales at a residence was ~nforced
was when a complaint is filed and that a complaint against us had
been filed by a competitor.
We were able to locate a commercial location that was both suitable
to our business and affordable. (Something that is very scarce in
Springfield.) We relocated our business to that location in
September, 1985.
Our business did well during the first couple of years, but since
then we've been faced with a series of eventa--al1 beyond our
control--which have had a negative affect. The repaving of Main
Street was one of these events. In spite of assurances that the
project would be completed rapidly and impact on businesses would
be kept to~'a lIinimun, the project had a deleterious affect on our
business. The work took place from MaJ to September, which is the
time of year when we g~nerate most of our annual income, and people
simply won~t, if at all possible, do business in an area where
street construction is occurring. In successive years, we were
faced with adverse weather conditions (i.e. rain and cold weather
long into the summer), the Spotted Owl, and the generally declining
economic situation in this area.

We've been very aware that we needed to take some drastic measures
in order to continue our business. We have cut our costs where~er
possible, kept our inventory to a minimum, lowered prices as far
as possible, and advertised as much as we could afford. Howe.er,
even though we've done the best we could to sell what inventory we
have, we find that we still have a few boats and motors in stock.
At this point it appears likely that we will be forced to drop
the retail portion of our business and have to return to doing
just outboard motor repairs at our home. We will continue doing
what we can to liquidate the remaining inventory, but we are also
requesting a conditional use permit for a 12 month period (October
1, 1991 to September 30, 1992) so that we can continue to liquidate
the inventory at our home if that becomes necessary.
Our sole income is generated by this business. A large part of
that income has been derived from the retail sales and income,
in the past, has been reinvested in new stock. Because of that,
we cannot afford to dispose of the product by throwing it away or
donating it to charity. In the~case of the new boats and motors,
the product was purchased outright so it cannot be returned to the
manufacturer. Therefore, it is imperative that we be able to sell
the items.
I am enclosing a list of the new and used boats and motors we
have in stock at this time. If the conditional use permit for
which we are applying is granted, you would be given access to
our receipts to verify that we are not adding merchandise in the
future and you would be able to verify that items being sold are,
indeed, just what we have in stock.
