Please be aware that under the Oregon Removal-Fill Law, removal, filling or alteration of 50 cubic yards or more of material within the bed or banks of the waters of this state requires a'permit from the Division of State Lands. Waters of the state include the Pacific Ocean, rivers, lakes, most ponds and wetlands, and other natural water bodies. Based on an initial assessment, it appears that you have not exceeded the 50 cubic yard limit and that no state permit is required at this time. As stated on site-fill is available in areas dominated by blackberries. If in the future you are planning removal or fill activities in waters of the state, please contact the division regarding permit requirements. For your information a copy of our brochure, Oreoon's Removal-Fill Permit PrDar~m, is enclosed. Please be aware that our decision does not negate other possible agency requirements for your activity, such as compliance with Section 404 of the Clean Water Act, administered by the U.S. Army Corps of Engineers.
