MINUTES OF THE REGULAR MEETING OF THE SPRINGFIELD CITY COUNCIL HELD MONDAY, JUNE 7,1999 The city of Springfield council met in regular session in the Springfield City Council Chamber Room, 225 Fifth Street, Springfield, Oregon, on Monday, June 7, 1999, at 7:00 p.m., with Mayor Maine presiding. ATTENDANCE Present were Mayor Maine, Councilors Ballew, Fitch, Hatfield, Leiken, Lundberg and Simmons. Also present were City Manager Michael Kelly, City Attorney Joe Leahy, Senior Management Analyst Rosie Pryor, City Recorder Julie Wilson and members of the staff. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Mayor Maine. SPRINGFIELD UPBEAT 1. Springfield Public Library's ReadQuest Summer Reading Program Kick-off. Librarian Judy Harold announced the kick off of the Springfield Library's ReadQuest Summer Reading Program and provided additional information regarding Library services. . CONSENT CALENDAR IT WAS MOVED BY COUNCILOR BALLEW, WITH A SECOND BY COUNCILOR HATFIELD, TO ADOPT THE CONSENT CALENDAR. THE MOTION PASSED WITH A VOTE OF 6 FOR AND 0 AGAINST. 1. Claims 2. Minutes a. ITEMS REMOVED FROM THE CONSENT CALENDAR PUBLIC HEARINGS 1. Ordinance Changing the Zone Designation on Property at 790 South 42nd Street from Low Density Residential to Medium Density Residential. ORDINANCE NO.1 - AN ORDINANCE AMENDING THE ZONING MAP FOR TAX LOT 1201, ASSESSOR'S MAP 18-02-05-22 IN THE CITY OF SPRINGFIELD, LANE COUNTY, OREGON FROM LOW DENSITY RESIDENTIAL TO MEDIUM DENSITY RESIDENTIAL. City Planner Mark Metzger presented the staff report on this issue. ORS 215.503 was recently amended to require City Councils to approve zone changes by ordinance. Section 12.030 of the Springfield Development Code describes the criteria to be used by the Council in considering rezoning requests. These criteria state that the proposed change: . 1. Must be consistent with the Metro Plan Text and Diagram. 2. Must be consistent with applicable Refinement Plans, special area studies and functional plans. 3. It must be shown that the property is able to be served by the orderly and efficient extension of key urban facilities and services. The subject property is currently zoned Low Density Residential (LDR) on the Springfield Zoning Map. The Metro Plan designation for the property is Medium Density Residential (MDR). Approval of the rezoning request would resolve the Plan/Zone conflict. The Planning Commission conducted a public hearing on the issue on June 1, 1999 and recommends approval of the rezoning request. This item is scheduled for a second reading and adoption June 21, 1999. There is no financial impact to the city budget. No action was taken, as this is a first reading of the ordinance. Mayor Maine opened the public hearing. No one appeared to speak. Mayor Maine closed the public hearing. 2. Lane-Klamath Fiber Consortium. ORDINANCE NO.2 - AN ORDINANCE RATIFYING THE CREATION OF THE REGIONAL FIBER OPTIC CONSORTIUM AND AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE THE INTERGOVERNMENTAL AGREEMENT CREATING THE CONSORTIUM ON BEHALF OF THE CITY OF SPRINGFIELD. . Regular Meeting Minutes June 7, 1999 Page 3 . Senior Management Analyst Len Goodwin presented the staff report on this issue. Staff of the involved local governments have continued discussions on the terms of an intergovernmental agreement to create a consortium (the Regional Fiber Consortium) to take control of and manage fiber optic cable donated to local governments by Pacific FiberLink. Staff has reached a consensus on the terms of the Intergovernmental Agreement to create the Consortium. ORS 109.085 requires that when an intergovernmental agreement creates a new entity, each participating local government must enact an ordinance ratifying the creation of the entity. No action was taken as the ordinance received a first reading only. Mr. Goodwin noted a typographical error contained on page 2, section 5, the third line from the bottom. This referenced the draft IGA dated May 28, 1999 and stated the date should be June 1, 1999. The ordinance would be corrected before 2nd reading of the ordinance on June 21, 1999. Mayor Maine opened the public hearing. No one appeared to speak. Mayor Maine closed the public hearing. BUSINESS FROM THE AUDIENCE COUNCIL RESPONSE CORRESPONDENCE AND PETITIONS . 1. Correspondence From Rob Zako, President, Friends of Eugene, 1280- B East 28th Avenue, Eugene, Regarding Trans Plan Summary Document Distribution. IT WAS MOVED BY COUNCILOR BALLEW, WITH A SECOND BY COUNCILOR HATFIELD, TO ACCEPT AND FILE THE CORRESPONDENCE. THE MOTION PASSED WITH A VOTE OF 6 FOR AND 0 AGAINST. 2. Correspondence From Bob Noble, City of Eugene, 28855 Lockheed Drive, Eugene, Transmitting the Draft Eugene Airport Master Plan Update Report. IT WAS MOVED BY COUNCILOR BALLEW, WITH A SECOND BY COUNCILOR HATFIELD, TO ACCEPT AND FILE THE CORRESPONDENCE. THE MOTION PASSED WITH A VOTE OF 6 FOR AND 0 AGAINST. Councilor Ballew reported on Metropolitan Wastewater Management Commission activities and discussed the proposed tree-planting project. She also discussed activity related to acquiring machines to speed drying bed capacity. 2. Councilor Fitch said the BRT group was still meeting and has continued to review alternatives and options. 3. Council Simmons reported on the National Marine Fishery regulations, specifically Rule 4d. He will have more information mid-summer. 4. Mayor Maine acknowledged that she and council members have attended many community events and thanked them for their participation. She said she did receive a complaint regarding a person who was displeased that a representative was not able to attend their event. Mayor Maine said the members do try to attend and participate at events as much as possible and there are times they are not able to do so. b. Other Business BUSINESS FROM THE CITY MANAGER 1.
