MINUTES OF THE REGULAR MEETING OF THE SPRINGFIELD CITY COUNCIL HELD MONDAY, MARCH 22,1999 The city of Springfield council met in regular session in the Springfield City Council Chamber Room, 225 Fifth Street, Springfield, Oregon, on Monday, March 22, 1999, at 7:00 p.m., with Mayor Maine presiding. ATTENDANCE Present were Mayor Maine, Councilors Ballew, Fitch, Hatfield, Leiken, Lundberg and Simmons. Also present were City Manager Michael Kelly, City Attorney Tim Harold, Senior Management Analyst Rosie Pryor, City Recorder Julie Wilson and members of the staff. BUSINESS FROM THE AUDIENCE 1. Gary Devereux, 329 South 70th Street, spoke regarding a notice of application he received on March 5, 1999, regarding a subdivision at 472 South 71 st Street. He expressed concern regarding flood conditions in the area. Mr. Devereux explained that he has communicated with a city planner regarding this issue. Staff was asked to follow-up on this issue and contact Mr. Devereux. PUBLIC HEARINGS 1. Rezon~ Certain Land in Glenwood Newly Incorporated Into the City of Springfield. . ORDINANCE NO. 5915 - AN ORDINANCE REZONING CERTAIN PROPERTY IN GLENWOOD FROM EUGENE ZONING DISTRICTS TO THE CITY OF SPRINGFIELD ZONING DISTRICTS CONSISTENT WITH THE METROPOLITAN AREA GENERAL PLAN TEXT AND DIAGRAM, AND DECLARING AN EMERGENCY. Planning Manager Greg Mott presented the staff report on this issue. The subject property was recently transferred from the corporate limits of Eugene to the corporate limits of Springfield by action of the Lane County Local Government Boundary Commission. The Boundary Commission cannot change the zoning of property, therefore, until the city of Springfield rezones this land all Eugene zoning designations are retained and enforceable only by the city of Eugene. This action is a part of the overall transfer of the jurisdiction of Glenwood from Eugene to Springfield. This action effects only that portion of Glenwood that had previously been annexed to the City of Eugene. On March 16, 1999, the Springfield Planning Commission conducted a public hearing on this matter. One person testified in support; no one spoke in opposition. The Planning Commission recommended approval of these zone changes based on [mdings of compliance as specified in the staff report. He explained that this zone change was being brought forth to the council. He explained that this step is now necessary due to policy changes. He said this was out of council's normal responsibilities they have had in the past. He said it was not just with the rezoning of Glen wood, which is the application before the council this evening, but will be with all zone changes in the future, in the City of Springfield. This is a result of Ballot Measure 56, adopted last November. . Mr. Mott said it requires rezoning to be concluded by ordinance. In the past it was not necessary. He said all zone changes will now come before council. He said he knows the council will treat them with the respect and evaluation they all deserve, even though council will be asked to make a decision on the process they would like to employ in the future. He would not recommend it for this particular one. City Code states that these types of actions, when they do come before council, if the Planning Commission has already conducted an evidentiary hearing, council's hearing will be on the record of that evidence compiled by the Planning Commission. He said in the context of upcoming fee City Council Work Regular Meeting March 22, 1999 Page 2 . discussion, council might want to consider implications and the cost of holding two evidentiary hearings as opposed to a single evidentiary hearing before the Planning Commission. Mr. Mott said this evening the request before them is for a zone change of the properties identified on the map. He said the request was initiated by the council to rezone the properties to Springfield zoning classifications to affect the implementation of the annexation of those properties (transfer of properties from the city of Eugene to the City of Springfield) which was effective at 5 :00 p.m. this evening. There was no request for an election. That property is now inside the corporate limits of the city of Springfield. It still possesses the city of Eugene zoning classification, therefore, the Development Services Department cannot exercise any jurisdiction until the property has been rezoned to the city of Springfield zoning. That is the action before council this evening. Mr. Mott said the criteria that council will use in deliberating this request is Article 12 of the Springfield Development Code, Section 12030. Those criteria are: 1. Consistency with Metro Plan Text and Diagram. 2. Consistency with Applicable Refinement Plan Special Area Studies and Functional Plans. 3. That the Property can be Served by the Orderly and Efficient Extension of Key Urban Facilities and Services as Prescribed in the Metro Plan Prior to or in Conjunction with Development. Mr. Mott said anyone testifying this evening should direct their comments to those criteria and those comments should be specific enough so that others participating in the hearing, in particular, council, has an ability to respond to those issues. A failure to raise an issue this evening will preclude that issue from being raised at the State Land Use Board of Appeals if this action is appealed. Mavor Maine opened the public hearing. . Mayor Maine asked council if anvone had a potential conflict of interest or exparte contact regarding this zone change. Mr. Mott provided a staff report. Mr. Mott announced that the entire record of the proceedings presented before the Planning Commission on March 16, 1999 is present at this meeting. The information included the two maps on the wall behind the council, a letter from Gazelle Investments dated March 10, 199 and a draft of the Planning Commission minutes. The Planning Commission has not yet reconvened since March 16 to approve the minutes. Mr. Mott referenced Exhibit A, the first page of the two-page table in the staff report. He said this identifies each of the properties that are highlighted on the map. It notes the Refinement Plan Designation, the size, the current Eugene Zoning, the Springfield Zone that corresponds to the Eugene zone, etc. Mr. Mott further discussed the Exhibit and referenced tax lot numbers 1000 and 1100. The document noted zoning as LMI or LDR but both of those should be LOR not LMI. He said in the future when they want to develop the property consistent with the plan, they will request a rezone to LMI. He also referenced several other lots on the next page of the report and clarified the appropriate zoning as follows: . Mr. Mott provided a staff summary. He discussed the emergency clause provision on the ordinance. He also discussed the intergovernmental agreement language. Mavor Maine closed the public hearing. This was an opportunity for discussion of policy issues and compliance with the adopted plans. Councilor Ballew commented that this was a very long process and everyone was pleased and welcomed all the property owners into the City of Springfield said the city is open for business. Councilor Fitch welcomed others to the City of Springfield and recognized Steve Moe for his diligence and efforts related to this issue. City Manager Mike Kelly provided an update and said things were on schedule between the two cities as far as the transfer of properties. He said police officers would become familiar with the area. Mr. Kelly said a meeting of some sort was planned to welcome property owners and businesses into the city, although, a date had not yet been scheduled for the event. Mr. Kelly also discussed the unincorporated areas and services related to these properties. Councilor Sid Leiken thanked those who worked so hard to make this transition happen. He also recognized the previous council and others for their efforts related to this issue. . IT WAS MOVED BY COUNCILOR BALLEW, WITH A SECOND BY COUNCILOR FITCH, TO ADOPT ORDINANCE NO. 5915.
