AN ORDINANCE REAPPORTIONING THE COSTS OF THE CONSTRUCTION OF CERTAIN LOTS OF DOUGLAS GARDENS SUBDIVISION FOR THE INSTALLATION OF ASPHALT PAVING, CURBS AND GUTTERS, SIDEWALKS, DRIVEWAYS, STREET TREES, STORM DRAINAGE AND STREET LIGHTING IMPROVEMENTS, TO SERVE SOUTH 34TH STREET, MAIN TO OREGON, AND VICINITY, PROJECT #1-926, IN THE CITY OF SPRINGFIELD, LANE COUNTY, OREGON, AND AMENDING ORDINANCE NO. 5853, PASSED BY THE SPRINGFIELD CITY COUNCIL ON MAY OS, 1997, AND DECLARING AN EMERGENCY. RECITAL: WHEREAS, the amount originally assessed against Tax Lot # 17-02-31-31-6700 by the adoption of Ordinance No. 5853 on May 05, 1997, was $32,300.34 and that in accordance with 3.150 through 3.156 of the Springfield Municipal Code, the record owner of the tract or parcel of property involved has presented the Finance Director with a written request that the assessment on tax lot nurnber 17-02-31-31- 6700 be reapportioned to various parts or parcels of such real property as follows: TaxLot#-17-02-31-31-6700 Assessment: $0.00 Lot 3, Block 2, Douglas Gardens, as platted and recorded in Book 4, Page 73, Lane County Oregon Plat Records in Lane County, Oregon recorded February 3, 1929, in Book 161, 172, Deed Record of Lane County Oregon. EXCEPT: That portion described in Deed to the State of Oregon, by and through the State Highway Commission, recorded January 24, 1968, Reception No. 11876, Official records of Lane County, Oregon. . Tax Lot # - 17-02-31-31-6704 Assessment: $32,300.34 The North 74.28 feet of Lot 4, Block 2, Douglas Gardens, as platted and recorded in Book 4, Page 73, Lane County Oregon Plat Records in Lane County Oregon, EXCEPT: The East 97.04 feet thereof. TaxLot#-17-02-31-31-6703 Assessment: $0,00 The East 97.04 feet of the North 74.28 feet of Lot 4, Block 2, Douglas Gardens, as platted and recorded in Book 4, Page 73, Lane County Oregon Plat Records in Lane County Oregon. NOW THEREFORE THE CITY OF SPRINGFIELD DOES ORDAIN AS FOLLOWS: Section 1: That the Engineering Division of the city's Public Works Department has completed the calculation for reapportionment to be as follows: Tax Lot Number Property Address Property Owner and Frontage Total Mailin2 Address 17-02-31-31-6700 3415 Main Street V & L Enterprises, Inc. Section 2: That the total sum of the reapportioruri.ent against the property and property owners described above is $32,200.34. Section 3 tfhat the Common Council does hereby determine the amount to be reapportioned against each lot, part of lot, or acreage property abutting upon and benefited by said construction, the owner or reputed owner thereof being named and all of said property being in the City of Springfield to be as calculated by the Engineering Division of the city's Public Works Department. Section 4: That the Common Council does determine that each lot, part of lot, or acreage property herein before described is specifically benefited to the extent of the reapportionment hereinbefore set forth and does hereby declare each and all of said reapportionment to be liens upon the respective lots, parts of lots, acreage property and tracts described against which said amounts are reassessed and orders and directs the City Recorder to enter in the docket of the city liens a statement thereof containing: 1,) The description of each lot, part of lot, or acreage property for. such improvement sufficient for identification, 2,) The name of the owner or reputed owner thereof or that the owner is unknown. 3.) The sum assessed upon such property and the date of entering the same in the docket of city liens. Section 5 !!That the Common Council hereby determines and declares said lots, parts of lots, or acreage property and tracts to be liable for the costs of the construction aforesaid. The Council further determines and declares that any nurnber of lots, parts of lots, and acreage property owned by anyone person or jointly by two persons shall be and they are hereby reassessed together and any such part shall be liable for the reassessment against the whole so owned by any such person or persons jointly. The former assessments levied against said property herein described as Tax Lot # 17-02-31-31-6700 by Ordinance No. 5853 is hereby amended as set forth in this ordinance. ADOPTED by the Common Council of the City of Springfield by a vote of ~ in favor and ~ against this 5th day of October, 1998.
