ORDINANCE NO. 5871 (EMERGENCY) AN ORDINANCE REGULATING FENCE MATERIALS BY AMENDING THE SPRINGFIELD DEVELOPMENT CODE ARTICLE 18 COMMERCIAL ZONING DISTRICTS AND ARTICLE 20 INDUSTRIAL ZONING DISTRICTS, AND DECLARING AN EMERGENCY. THE CITY COUNCIL OF THE CITY OF SPRINGFIELD FINDS THAT: 1. The Springfield Development Code (SDC) was adopted by the Springfield City Council on May 5, 1986, and amendments thereto were subsequently adopted by Ordinance. 2. On December 16, 1997, the Springfield Planning Commission held a public hearing on this SDC amendment request (Jo. No. 97-10-226). The Springfield Planning Commission voted -L in favor, ----1! opposed, to recommend approval of these amendments to the City Council. 3. Findings in support of these amendments to the SDC are set forth in the Staff Report and the Recommendation to Council, Jo. No. 97-10-226), incorporated herein by reference. 4. Based on the above record and fmdings, the City Council concludes that the SDC amendments are consistent with the criteria of approval as set forth in the Staff Report and Recommendation to Council, Jo. No. 97-10-226, incorporated herein by reference. . Now therefore, based on the above findings, THE CITY OF SPRINGFIELD CITY COUNCIL DOES ORDAIN AS FOLLOWS: Section 1: Section 18.100 is hereby amended by the addition of the following language as described below: (1) General (a) Except as specified elsewhere in this Code, fences shall not exceed the height standards listed below and shall be located as follows: 3. Barbed wire, razor wire or electrified fencing shall be permitted atop a six foot fence. The total height of the fence with these materials affixed shall not exceed 8 feet. These materials shall not extend into the vertical plane of adjoining public sidewalks. Barbed wire or razor wire only fences are prohibited. Electrified fencing must be posted with warning signs every 24 feet. Section 2: Section 20.090 is hereby amended by the addition of the following language as described below: (1) General . .... . . . Section 3: It is hereby determined that matters pertaining to fence height and materials affect the public welfare of the City of Springfield and that an emergency exists, and that this ordinance shall therefore take effect immeiliately upon its passage by the Council and approval by the Mayor. ADOPTED by the Common Council of the City of Springfield by a vote of ~ for and ~ against this 20thday of January, 1998.
