ORDINANCE (Special) No. 5870 AN ORDINANCE ADOPTING THE REPORT OF THE CITY ENGINEER FOR IMPROVEMENTS TO SERVE 2475 31ST STREET (2-061), AND DECLARING AN EMERGENCY. NOW THEREFORE THE CITY OF SPRINGFIELD DOES ORDAIN AS FOLLOWS: Section 1: The Spr~ngfield City Council on January 20, 1998, did initiate construction of sewer improvements to serve 2475 31st Street (2- 061), including installation of an eight-inch, 120-foot long sanitary sewer. At the direction of the Council, the City Engineer filed his report with the City Recorder on January 12, 1998, and the report filed is hereby adopted. Section 2: A public hearing will not be held as the property owner has signed a waiver agreeing to pay all costs of the, project and waiving all public hearings and standard procedures of the assessment process. Section 3: The property owner's septic tank drain field is failing and presents an immediate threat to public health. The need for sanitary sewer requires prompt execution of a contract for the above improve- ment project to remedy the threat to public health. Accordingly, the competitive bid process is modified pursuant to Springfield Municipal Code 2.710 (14). Written quotes from three or more contractors have been solicited for construction of the above improvement project in accordance with the City's general conditions and standard specifications; and, the project shall be awarded forthwith to the lowest responsible bidder. Section 4: Such improvement is necessary for the immediate preservation of the public health, safety, and welfare of the City of Springfield and therefore an emergency exists and this ordinance shall be effective immediately upon passage by the Council and approval by the Mayor. Adopted by the Common Council of the City of Springfield, Oregon, this 20th of ~uaa.-l9g8by a vote of 5 for and 0 against.
