In consideration for the issuance of a Building Permit issued by the City of
Springfield which allows the owner(s) to construct an office building up to the
property line without adherence to certain setback requirements of the
Springfield Building Safety Code pertaining to the common property line of
parcels described above, the record owner(s) do hereby make the following
covenant (for the good and safety of the public, in compliance with the
building regulations of the City of Springfield), covering the above described
real property, specifying that this covenant shall constitute a limitation to
run with the land and shall be binding on all persons claiming under them, and
that the covenant shall be for the benefit of present and future owners of said
real property.
Be it hereafter known and agreed that the land described above which includes
two lots, must either hereafter:
1. Be sold together without separation of the parcels or portions thereof as a
single unit of land so long as the office building is constructed within
the required side yard setback; or
2. A Lot.Line Adjustment application must be applied for and approved by the
City to allow the parcels to be sold individually (adherence to the setback
requirements in affect at the time of the Lot Line Adjustment application
shall be required); or
3. Prior to the sale of the parcels individually, the office building shall be
removed.
