IN CONSIDERATION of 'the covenants herein recited~he City of Springfield,
hereinafter referred to as City, and Raloh Johnson and Linda Johnson
hereinafter referred to as Applicant, do covenant and agree as follo..s:
YHEREAS Applicant desires Development Approval from City; and
YHEREAS,
cause both an
City;
any future
immediate
development ..ithin City or its Urban Gro..th Boundary ..ill
and long-term demand on the various public facilities of
NOY THEREFORE, Applicant and City agree to the follo..ing schedule of public
facility improvements and respective cost assumption policy:
STREET IMPROVEMENTS along the frontage of

[XI gutters; !XI planter strips; 1XI street trees; 1XI
South 15th Street

TRAFFIC SIGNALS at the intersection of
the required 5' landscape strip including street trees shall be
OTHER IMPROVEMENTS: installed at the time of South 15th Street construction.

IT IS FURTHER UNDERSTOOD that Applicant agrees to sign any and all ..aivers,
petitions, consents and all other documents necessary to obtain the above listed
improvements under any improvement act or proceeding of the State of Oregon, Lane
County, or City as may be proposed or adopted and to ..aive all right to remonstrate
against such improvements, but not the right to protest the amount or manner of
spreading the assessment thereof,' if the same shall appear to Applicant to bear
inequitably or unfairly upon said property of Applicant;
NOY THEREFORE, City agrees that Applicant's execution and performance of the
terms of this Agreement ..ill be deemed to be in compliance ..ith City's policy
pertaining to improvement requirements, and if Applicant complies in every respect
..ith all other applicable la..s of the State of Oregon, Lane County, and City, the
said Applicant shall be entitled to Development Approval; and
IN ADDITION, it is the intention of the parties hereto that the covenants herein
contained shall run ..ith the land herein described, and shall be binding upon the
heirs, executors, assigns, administrators, and successors of the parties hereto, and
shall be construed to be a benefit and a burden upon the property herein described.
This Agreement shall be recorded in the Lane County Deed Records.

Beginning at a poing South 89'14' East 2472.20 feet and South 0'23'30" West
557.01 feet from the Northwest corner of the Issac Briggs Donation Land Claim
No. 83, Township 17 South, Range 3 West, of the Willamette Meridian, said point
being on the Southerly right of way line of South A Street on the East line of
a tract of land owned by the City of Springfield and recorded in Book 371,
Page 582, Lane County Oregon Deed Records, in Lane County, Oregon; thence South
0'23'30" West 125.00 feet along the East line of said City of Springfield tract;
thence North 89'56'30" East parallel with the Southerly right of way line of
South A Street 169.36 feet; thence North 0'23'30" East 125.00 feet to a point
on the South right of way line of South A Street; thence South 89'56'30" West 169.36
feet along said right of way line to the Point of Beginning, all in Springfield,
