RESOLUTION NO. 07-46
A RESOLUTION CLARIFYING THE METHOD OF ANNEXATION FOR CERTAIN TERRITORY
TO THE CITY OF SPRINGFIELD
WHEREAS, the City Council adopted Resolution No. 07-36 on July 16,2007; and
WHEREAS, Resolution No. 07-36 identified ORS 199.490(2)(a)(B) as the applicable statute authorizing
annexation; and
WHEREAS, the City Council finds that Resolution No. 07-36 was intended to initiate annexation under
ORS 199.490(2)(a)(A), which allows annexation upon receiving consent in writing from more than half
of the owners of land in the territory proposed to be annexed, who also own more than half of the land in
the territory proposed to be annexed and of real property therein representing more than half of the
assessed value of all real property in the territory proposed to be annexed; and,
WHEREAS, the city finds there are no registered voters residing within the territory; and
WHEREAS, the city finds the request complies with ORS 199.490(2)(a)(A) for the reasons stated in the
report attached to Resolution No. 07-36.
NOW THEREFORE BASED ON THE FOREGOING RECITALS, THE COMMON COUNCIL OF
THE CITY OF SPRINGFIELD DOES RESOLVE AS FOLLOWS:
Section 1: The Common Council of the City of Springfield does hereby clarify that Resolution No. 07-36
should refer to ORS 199.490(2)(a)(A) as the applicable statute authorizing annexation.
Section 2: This resolution shall take effect upon adoption by the Common Council of the City of
Springfield and approval by the Mayor.
ADOPTED by the Common Council of the City of Springfield this 5th day of November, 2007 by a vote
of ~ for and ~ against. (1 absent)
