RESOLUTION 99 - ~
AUTHORIZING THE MAXIMUM RATES TO BE CHARGED FOR THE
COLLECTION OF GARBAGE AND REFUSE
WHEREAS, Springfield Municipal Code Section 4.408(2) provides that the maximum rates for the
collection of garbage and refuse for a month shall be set by resolution of the Council; and
WHEREAS, the present rate for the collection of garbage and refuse consists oftwo parts: 1 )the rate
which accounts for the cost of collection of garbage and refuse by the collector of garbage (the
"collection rate"), and 2)the rate which accounts for the fees imposed by Lane County for the
disposal of garbage and refuse collected by the collector of garbage (the "disposal rate"); and
WHEREAS, Sanipac, Inc., the collector of garbage as defined by Springfield Municipal Code
Section 4.400, has requested that the maximum rates currently fixed be adjusted, by providing for
a surcharge to the disposal rate of$0.11 per residential customer per month forthe cost of collection
of recyclable plastic and by providing for an adjustment disposal rate by changing the allocation
of the fee collected by Lane County for the disposal of garbage and refuse among the various can
sizes; and
WHEREAS, the collector of garbage has provide certain information and material in support of its
request; and
WHEREAS, City staff have reviewed the request of the collector of garbage, and the additional
information and material provided in support of the request; and
WHEREAS, City staff, following such review have recommended that the adjustment of the
allocation of the fee collected by Lane County for the disposal of garbage and refuse be approved
as requested; and
WHEREAS, City staffhave recommended that the surcharge for the collection of recyclable plastic
not be approved as requested, but, in the alternative, be allowed as a temporary surcharge, to be
imposed until such time as the revenue from disposal of such plastic exceed zero for two consecutive
calendar quarters; and
WHEREAS, City staff have recommended that collector of garbage report quarterly to the City the
total revenue from recycling; and
WHEREAS, the Council has considered the request of the collector of garbage, the material and
information submitted in support of such request, and the analysis and recommendations ofthe staff,
and is fully informed as to the request and the circumstances;

NOW THEREFORE, BE IT RESOLVED, that the request ofthe collector of garbage is approved,
with the conditions as set forth herein and that from and after April 1 , 1999, the maximum rates for
the collection of garbage and refuse for a month shall be as set forth on Schedule A, attached hereto
and incorporated by this reference herein; and
BE IT FURTHER RESOLVED, that the collector of garbage is hereby directed to file, not later
than the 21 sl day following the end of each calendar quarter, a report of all Springfield recycling
revenue for the immediately preceding quarter (the "Recycling Revenue Report"); and
BE IT FURTHER RESOLVED, that the surcharge for the collection of recyclable plastic in the
amount of $0.11 per residential customer per month shall expire at such time as Springfield
Recycling Revenue, as reported in the Recycling Revenue Report, shall be greater than zero for two
consecutive calendar quarters.
