ISSUE STATEMENT: ATTACHMENTS: DISCUSSION: The property owners, Michael Evans and Geraldine Betz, have requested annexation of approximately 0.69 acre of property located at 2793 Pheasant Blvd. The subject territory is described as Assessor's Map Number, I 7-03-22-42, Tax Lots 2500, 2600 and 2700 and more accurately described in Attachment I, Exhibit A. The site contains one residence. Article 6.030(2) of the Springfield Development Code requires that territories considered for annexation must be provided with "key urban facilities and services", as defined in Metro Plan Policy 8.a, Page II-B-4. Among these key urban services are water, sewer, storm water facilities, streets, electricity, parks, fire/emergency services, and schools. Based on analysis and comments from the service providers, staff finds that all key urban services are available to serve the territory. Attachment 1: Resolution Attachment 2: Informational Attachment Attachment 3: Vicinity Map Attachment 4: Submittal from Applicant The City Council is authorized by ORS 199.490(2)(a)(A) to initiate annexation using the triple majority method. This requires consent in writing from a majority of the land owners of the territory to be annexed, who also own more than half of the land in the territory proposed to be annexed and of real property therein representing more than half of the assessed value of all real property in the territory proposed to be annexed. Oakdale Avenue between Game Farm Rd. and Pheasant Blvd. is also being annexed as part of this process. The property is comprised of three lots. Electric, water, telephone, cable and natural gas are stubbed to each lot. Although none of the lots are connected to sanitary sewer, there is an 8" sanitary line approximately 160' west of the subject property within Oakdale Avenue, west of Pheasant Boulevard. There is also a 24" sanitary line approximately 250' south of the subject property. Each lot must connect to sanitary service prior to development. The City Council Resolution will be forwarded to the Lane County Local Government Boundary Commission. The owners are requesting the Expedited Annexation procedure of the Boundary Commission. RESOLUTION NO. A RESOLUTION INITIATING ANNEXATION OF CERTAIN TERRITORY TO THE CITY OF SPRINGFIELD AND REQUESTING THAT THE LANE COUNTY LOCAL GOVERNMENT BOUNDARY COMMISSION APPROVE THE ANNEXATION BY EXPEDITED PROCESS. WHEREAS, the City received an application to annex 0.69 acre into the City of Springfield on May 9, 2007, said territory being described as follows: Township 17 South, Range 3 West, Section 22, Map 42, Tax Lots 2500,.2600 and 2700, including a portion of Oakdale Avenue, and more particularly described in Exhibit A of this Resolution. WHEREAS, the territory proposed to be annexed IS within the Eugene-Springfield Urban Growth Boundary, and is adjacent to the City Limits; and WHEREAS, the City Council is authorized by ORS. 199.490(2)(a)(A) to initiate annexation upon receiving consent in writing from a majority of the electors registered in the territory proposed to be annexed and written consent from more than half of the owners of land in the territory proposed to be annexed, who also own more than half of the land in the territory proposed to be annexed and of real property therein representing more than half of the assessed value of all real property in the territory proposed to be annexed; and, WHEREAS, the property owners of the certain territory described in Exhibit A signed a consent to annex (Exhibit B); and, WHEREAS, the City Council is authorized by Springfield Development Code 6.030(2)(a) and ORS 222.111 and other applicable Oregon Revised Statutes to initiate annexation when the territory in the annexation proposal can be provided with the minimum level of key urban facilities and services in an orderly and efficient manner as defined in Eugene-Springfield Metro Area General Plan Policy 8, page ll- B-4; and where there will be a logical area and time within which to deUver urban services and facilities; and WHEREAS, minimum level key urban facilities and services are defined in the Eugene-Springfield Metro Area General Plan, page V-3 as wastewater service, stormwater service, solid waste management, water service, fIre and emergency medical services, police protection, city-wide parks and recreation programs, electric service, land use controls, communications facilities and services, and public schools on a district- wide basis; and WHEREAS, the territory proposed to be annexed can be immediately provided with a minimum level of key urban facilities as described in Attachment 2; and WHEREAS, the City Manager is authorized to forward this resolution supporting the applicant's request for expedited processing to the Lane County Local Government Boundary Commission; and WHEREAS, the City supports the applicant's request for expedited Boundary Commission processing. ATTACHMENT 1 - 1 NOW THEREFORE BASED ON THE FOREGOING RECITALS, THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD DOES RESOLVE AS FOLLOWS: Section 1: The Common C;ouncil of the City of Springfield does hereby recommend approval of the annexation of the subject territories to the City by the Lane County Local Government Boundary Commission, Lane County, Oregon, said territories being described as follows: Township 17 South, Range 3 West, Section 22, Map 42, Tax Lots 2500, 2600 and 2700, including a portion of Oakdale Avenue and more particularly described in Exhibit A of this Resolution. Section 2: This resolution shall take effect upon adoption by the Common Council of the City of Springfield and approval by the Mayor. Section 3: The City Council recomr.nends that the Boundary Commission approve the proposed annexation authorized by QRS 199.466 by expedited process without the study, public hearing and adoption of final order required by QRS 199.461. Section 4: The City Manager shall forward this resolution supporting the applicant's request for expedited processing to the Lane County Local Government Boundary Commission. Date: s- r _t) I ATTACHMENT 1 - 4 Informational Attachment For the proposed annexation of ::l::0.69 acre of property located at 2793 Pheasant Blvd. The area is described on Lane County Assessor's Map 17-3-22-42, Tax Lots 2500, 2600 and 2700. Zoning The Low Density Residential (LDR) zoning of the subject property is consistent with the Metropolitan Area General Plan. The property meets the minimum requirements for parcel size and frontage on an east-west street (4,500 square feet and 45 feet of frontage). Sanitary Sewer Each lot is undeveloped and is not currently served by sanitary sewer. There is an 8" sanitary line approximately 160' west of the site within Oakdale Avenue west of Pheasant Boulevard. There is a 24" sanitary line approximately 250' south of the site. Each lot must connect to the sanitary service prior to development. Solid Waste Management The City and Sanipac have an exclusive franchise arrangement for garbage service inside the city limits. Upon annexation, Sanipac will serve this property. Water Service The site is currently served by the Rainbow Water District. It will not be served by SUB until July I st of the year following the annexation. Electric SUB (Springfield Utility Board) is currently providing electrical service to the lots. Fire and Life Safety The Fire Marshal has reviewed the application and has determined that fIre and emergency services are available to this site. The subject property is within the 4 minute response time of Fire Station #5. Police Protection Upon annexation, the area will receive police protection from the City of Springfield. Police protection and response to priority calls can be provided to this site upon annexation consistent with service protection throughout the city. Parks and Recreation Programs After annexation to the City of Springfield, the subject property will be within the Willamalane Park and Recreation District boundary. City residents receive park and recreation services from the District. The District operates two aquatic centers, a Community Center, an Adult Activity Center, and 31 parks containing a variety of outdoor recreational amenities. Land Use Controls The City of Springfield Development Services Department has provided all planning and building functions for the citizens and property owners of the subject property. The City of Springfield Development Services Department will continue to provide land use control for the site after the annexation. ATTACHMENT 2 - 1 Communication Facilities Qwest and AT&T currently provide communications in the area for cable service and an array of wireless companies provide different communication services. The City has no exclusive franchise arrangements with telecommunication or wireless companies. The field is competitive and therefore guarantees a wide selection. Public Schools Public School services are available through School District 19. Guy Lee Elementary School is approximately Y<t mile away on Harlow Road. Hamlin Middle School is approximately 1 mile from the subject property. Stormwater Control Any future development or redevelopment on this site will require appropriate stormwater management techniques in accordance with City standards. Transportation and Right of Way The subject property is adjacent to Pheasant Boulevard to the west and Oakdale Avenue to the north. The portion of Pheasant Boulevard adjacent to tax lot 2700 is a City street. Oakdale Avenue is outside the city limits (within the UGB) and is a Lane County maintained road.It is functionally classified as an Urban Local road, having a platted right-of-way width of 60 feet. It has a 24' paved surface with curb and gutter on both sides of the street, but no sidewalk adjacent to tax lots 2500 and 2600. Sidewalk and street lighting improvements can be obtained with an improvement agreement during the future land division. That portion of Oakdale Avenue between Pheasant and Game Farm is included in this annexation. This includes the entire 60' right of way for a distance of approximately 300' from the intersection with Pheasant Boulevard to the intersection with Game Farm Rd. After annexation, this section of Oakdale Ave. will continue to be maintained by Lane County. Annexation of the right of way will allow extension of services without an extraterritorial agreement and will continue the connectivity of the city street system. Tax lot 2700 contains a two story single-family dwelling that is served by a subsurface sewage disposal system located on the parcel. It was created as lot 4, Block 1, Farrndale Subdivision. Electric, telephone, television, Rainbow Water and Northwest Natural Gas facilities are located along the West side of tax lot 2700, and the North side of tax lots 2500, 2600 and 2700. Utility service connections exist upon each parcel. The property is level with an elevation of approximately 439 feet MSL except the most Northerly and Westerly 10 feet, which slopes down approximately 1 Yz feet to the top of curb. Tax lots 2500 and 2600 and the South 50 feet of 2700 consists of a grass cover with a few small scattered trees along the back and side boundaries. The North portion of tax lot 2700 contains a dwelling and typical residential yard, shrub and tree landscaping. The property does not contain any special site features and is within floodplain zone X - above the 500 year flood. PURPOSE OF ANNEXATION Without annexation one additional dwelling might be possible on tax lot 2600 with a supporting subsurface sewage disposal system on tax lot 2500. . Annexation will allow the extension of public sewer to serve the individual parcels which otherwise have all utilities and services available that are necessary to allow residential development. The annexation will allow the construction of single-family dwellings on tax lots 2500 and 2600, and an additional dwelling (after partitioning) on tax lot 2700. . PW Transportation would support annexation of the entire roadway though. Saying that, it would be the City Engineer that has the final decision on this, working though Les Benoy. They may have other issues that we are not aware of. At any rate, some reason for/against annexing: For * Pheasant Blvd, to the west, is within the City limits. Annexing Oakdale Avenue would continue the connectivity of the City street system, especially in the event that * . * Game Farm Road becomes a future city facility. * The sidewalk system extends in front of the first parcel to the west. The next two parcels are empty lots and does not have sidewalk on its frontage. The sidewalk then picks up just to the east of the subject parcels. Annexing at least that portion of the roadway would allow construction and connectivity of the sidewalk system. If we did not annex, then we would at least want to get an IA for the sidewalk, even though we'd be foregoing a sidewalk facility now. (By the way, we'd want to get an IA for street lights whatever happens.) * Without annexing the street portion, the residents could run into the issue of who supplies emergency services. Against Maintenance for the roadway would not be a City responsibility. The road is not "fully" developed according to City code...as there are no street lights along.this portion of the roadway. Again, there may be other reasons for annexing or not from PW Engineering's perspective. The picture below shows the 3 properties of concern highlighted. Greg K. The portion of Pheasant Boulevard adjacent to TL 2700 is a City street. Oakdale Avenue is a Lane County maintained road (LCR) within the Springfield Urban Growth Boundary. It is functionally classified as an Urban Local road, having a platted right-of-way width of 60 feet. It has a 24' paved surface with curbs and gutters, but no sidewalk adjacent to TLs 2500 and 2600. Driveway spacing for this road is 20 feet [LC 15.138(2)]. A facility permit is required for each new access. LANE COUNTY FACILITY PERMIT A Facility Permit shall be required for placement of facilities within the right-of-way of Oakdale Avenue. Facilities and development includes, but is not limited to, road improvements, sidewalks, new or reconstructed driveway or road approach intersections, utility placements, excavation, clearing, grading, culvert placement or replacement, storm water facilities, or any other facility, thing, or appurtenance [LC 15.205(1)].
