BEFORE THE CITY COUNCIL OF SPRINGFIELD, LANE COUNTY, OREGON ORDINANCE PA 1144 )IN THE MATTER OF AMENDING THE EUGENE-SPRINGFIELD METROPOLITAN AREA )GENERAL PLAN DIAGRAM AND GATEWAY REFINEMENT PLAN TO ENLARGE THE )URBAN GROWTH BOUNDARY AND ADOPT AN EXCEPTION PURSUANT TO )STATEWIDE PLANNING GOAL 2, REDESIGNATE LAND FROM "AGRICULTURE" TO )"PARKS AND OPEN SPACE" AND "NATURAL RESOURCE", AND REZONE THAT LAND )FROM LANE COUNTY "EXCLUSIVE FARM USElFLOODPLAIN COMBINING (E-30IFP)" )TO SPRINGFIELD "PUBLIC LANDS AND OPEN SPACE"; AND ADOPTING SAVINGS AND )SEVERABILITY CLAUSES; AND DECLARING AN EMERGENCY WHEREAS, Chapter IV of the Eugene-Springfield Metropolitan Area General Plan ("Metro Plan") sets forth procedures for amendment of the Metro Plan, which for Lane County are implemented by the provisions of Lane Code 12.200 through L.C. 12.245; and WHEREAS, pursuant to Ordinance 886, Lane Code Chapter 16 zoning is applied to lands within the jurisdiction of the Metro Plan but outside the Urban Growth Boundaries of Eugene and Springfield, and Lane Code 16.400(6)(i) allows zone changes to be processed concurrent with Plan amendments; and WHEREAS, pursuant to Lane County Ordinance PA 925, City of Springfield zoning districts have been applied to lands within the Urban Growth Boundary of the Eugene-Springfield Metropolitan Area General Plan ("Metro Plan") but outside the city limits of the City of Springfield; and WHEREAS, pursuant to Lane County Ordinance PA 1013, the Gateway Refinement Plan was adopted by Lane County in 1992; and . WHEREAS, on July 1995, the Springfield City Council initiated proceedings for a Metro Plan amendment, Gateway Refinement Plan amendment, and concurrent zone change for purposes of expansion of the Urban Growth Boundary to add a 34.7-acre tract, redesignate this land and rezone this land; and WHEREAS, the Planning Commissions of Lane County and Springfield have held public hearings to consider the proposed amendments and zone change; and have recommended approval; and WHEREAS, on November 8, 1999, the Board of County Commissions conducted a joint public hearing with the Springfield City Council on the proposed amendments and rezoning and is now ready to take action; and WHEREAS, evidence exists within the record indicating that the proposal meets the requirements of the Metro Plan, of Lane Code Chapter 10, and of applicable state and local law. NOW, THEREFORE, the Common Council of the City of Springfield Ordains as follows: Section 1. The Metro Plan Diagram and Gateway Plan Diagram is amended by the addition of a 34.7 acre tract identified as assessor's map 17-03-15, tax lot 1000, to the Urban Growth Boundary, as depicted in Exhibit "A" attached hereto and incorporated herein. Section 2. The Metro Plan Diagram and the Gateway Plan Diagram are further amended by the redesignation of the site identified as assessor's map 17-03-15, tax lot 1000 , from "Agriculture" to "Natural Resource" and "Park and Open Space", as depicted in Exhibit "B" attached hereto and incorporated herein. . IN THE MATIER OF AMENDING THE EUGENE-SPRINGFIELD METROPOLITAN AREA GENERAL PLAN DIAGRAM AND GATEWAY REFINEMENT PLAN TO ENLARGE THE URBAN GROWTH BOUNDARY AND ADOPT AN EXCEPTION PURSUANT TO STATEWIDE PLANNING GOAL 2, REDESIGNATE LAND FROM "AGRICULTURE" TO "PARKS AND OPEN SPACE" AND "NATURAL RESOURCE", AND REZONE THAT LAND FROM LANE COUNTY "EXCLUSIVE FARM USFlFLOODPLAIN COMBINING (E-30/FP)" TO SPRINGFIELD "PUBLIC LANDS AND OPEN SPACE"; AND ADOPTING SAVINGS AND SEVERABILITY CLAUSES Page I of2 Ff) \/ Ordinance 5945 page t e- Section 3. The site identified as assessor's map 17-03-15, tax lot 1000, is rezoned from Lane County rural zoning district of "Exclusive Farm Use/Floodplain Combining (E-30/FP)" to City of Springfield zoning district of "Public Lands and Open Space", as depicted in Exhibit "C" attached hereto and incorporated herein. Section 4. Findings of fact made pursuant to LCDC Statewide Planning Goal 2 exception criteria and Goal 14 factors for the property described in section 1 of this Ordinance, taken in accordance with Oregon Administrative Rule requirements for Urban Growth Boundary amendments, as set forth in pages one through six of Exhibit "D" attached to this Ordinance, are adopted as part of the Metro Plan. Section 5: It is determined by the Common Council that matters pertaining to the amendment affect the public health, safety and welfare and that an emergency exists and this ordinance shall become effective upon adoption by the Council and approval by the Mayor. The prior designation and zone repealed by this Ordinance remain in full force and effect to authorize prosecution of persons in violation thereof prior to the effective date of this Ordinance. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not effect the validity to the remaining portions hereof.
