5952
(General)
AN ORDINANCE AMENDING CHAPTER 5, "PUBLIC PROTECTION," ADDING
PROTECTIONS FOR THE RESIDENTS OF THE CITY BY PROHIBITING
DISORDERLY CONDUCT AND HARASSMENT ON PUBLIC AND PRIVATE PROPERTY.
The City of Springfield, Oregon finds as follows:
1. Disorderly conduct. and harassment of various kinds on
public and private property adversely affects the health, safety
and welfare of citizens, and diminishes the quality of life in
the City. Disorderly conduct constitutes a nuisance.
2. The City has a substantial and compelling interest in
protecting the health, safety and welfare of its citizens.
3. The legal processes presently available do not
adequately control disorderly conduct and harassment nor its
detrimental affects on the citizens of the City.
NOW THEREFORE the city of Springfield Ordains as follows:
section 1 There is hereby added to the Springfield Municipal
Code, Chapter 5, "Public Protection," section 5.058, "Disorderly
Conduct" as follows:
"5.058 Disorderly Conduct.
(1) A person commits the crime of disorderly conduct
if, with intent to cause public inconvenience,
annoyance or alarm, or recklessly creating a risk
thereof, the person:
(a) Engages in fighting or in violent,
tumultuous or threatening behavior; or
(b) Makes unreasonable noise; or
(c) Disturbs any lawful assembly of persons without
lawful authority; or
(d) Obstructs vehicular or pedestrian traffic on a
public way; or

(e) Congregates with other persons in a public place
and refuses to comply with a lawful order of the police
to disburse; or
(f) Creates a hazardous or physically offensive
condition by any act which the person is not licensed
or privileged to do."
section 2 There is hereby added to the Springfield Municipal
Code, Chapter 5 "Public Protection", Section 5.059 "Harassment as
follows:
5.059 Harassment.
A person commits the crime of harassment if the person
intentionally harasses or annoys another person by:
(a) Subjecting such other person to offensive
physical contact; or
(b) Publicly insulting such other person by
abusive words or gestures in a manner
intended and likely to provoke a violent
response.
Adopted by the Common Council of the City of Springfield this 18th
