ORDINANCE 5951
(General)
AN ORDINANCE AMENDING CHAPTER 5, "PUBLIC PROTECTION,"
PROVIDING PROTECTIONS FOR RESIDENTS BY PROVIDING REGULATIONS FOR
THE PROPER USE OF THE CITY LIBRARY.
The City of Springfield, Oregon finds as follows:
(1) The causing of disturbances or unreasonable noise in the
City Library adversely affects the health, safety and welfare of
the citizens, and diminishes the quality of the library. The
causing of disturbances or unreasonable noise in the City Library
constitutes a nuisance.
(2) The City has a substantial and compelling interest in
protecting the health, safety and welfare of its citizens who use
the library and of the library itself.
(3) The legal processes presently available will not readily
alleviate the nuisance created by improper use of library.
(4) Establishing the proposed Ordinance will alleviate the
nuisance created by the library by providing an ordinance to
regulate library use.
NOW, THEREFORE, the City of Springfield ordains:
Section 1. There is hereby added to the Springfield
Municipal Code, Chapter 5, "Library Use", as follows:
5.062 Prohibition of Disturbance and Unreasonable N\)ise.
(I) The City Library patrons may only use the interior of
the library premises for reading, studying, computer research, or
to use other library materials and resources.
(2) Library patrons are prohibited from causing disturbances
or unreasonable noise in the Library.
(a) A disturbance is defined as any conduct by an individual
which interferes with a patron's use of the Library or interferes
with the conduct and operation of the City Library.
(b) An unreasonable noise is defined as any loud,
unnecessary, or unusual noise which disturbs the peace and quiet
of the City Library or which causes interference with the use of

the library by a reasonable person of normal sensitiveness. The
standards which may be considered in determining whether an
individual has caused interference with a patron's use of the
library, include but are not limited to the following:
1. Level of the noise;
2. Whether the nature of the noise is usual or unusual;
3. Whether the origin of the noise is natural or
unnatural;
4. The duration of the noise;
5. Whether the noise is recurrent, intermittent, or
constant.
Adopted by the Common Council of the City of Springfield this
