ORDINANCE NO. 5938 (General) AN ORDINANCE AMENDING SECTIONS 5.000 AND 5.614(1) OF THE SPRINGFIELD MUNICIPAL CODE CLARIFYING THAT THE CITY MANAGER OR HIS OR HER DESIGNEE IS THE ENFORCING OFFICER AND MAY UNDERTAKE ACTIONS TO OBTAIN COMPLIANCE AND SIGN CIVIL INFRACTION CITATIONS FOR PURPOSES OF CIVIL ENFORCEMENT OF CODE INFRACTIONS. The City of Springfield finds as follows: In order to clarify the intent of the Council as expressed in Section 1.105 of the Springfield Municipal Code that Sections 5.000 and 5.614 regarding the definition of Enforcing Officer and Uniform Infraction Citations and Complaints be interpreted that the City Manager or his or her Designee is the Enforcing Officer and may be responsible for compliance and Civil Enforcement of Code Infractions and the City Manager or his or her Designee may sign the Uniform civil Infraction Citation, it is necessary to amend Sections 5.000 and 5.614(1) of the Springfield Municipal Code to so state: NOW THEREFORE the City of Springfield Ordains as follows: Section 1 Springfield Municipal Code Chapter 5 "Public Protection" Article 5.000 Nuisances in General" definitions is hereby amended as follows: "5.000 Definitions. For purposes of section 5.000 through 5.012 the following means: *** Enforcinq Officer. The City Manager or his or her designee." *** Section 2 Springfield Municipal Code Chapter 5 "Public Protection", Article 5.600 civil Enforcement of Code Infractions, and specifically section 5.614 "Uniform Infraction Citation and Complaint" (1) is hereby amended as follows: "5.614 Uniform Infraction Citation and Complaint. (1) If the recipient of a prior written notice described in section 5.608 fails to comply with the provisions set out therein, or fails to comply with any term of a voluntary compliance agreement or if the city manager or his or her designee deems the prior written notice provision to be inapplicable because of the need to move quickly becaus0 of other Attachment I page 1 . '. , . circumstances affecting the public health, safety or welfare, then a uniform civil infraction citation signed by the city manager or his or her designee shall be filed with the municipal court, charging the recipient with a civil infraction and setting a date for the person to appear before the municipal court to answer the charge."
