Dear Mr. Urhansen:
Subject: 952 and 954 Prescott Lane
Thank you for your courtesy and cooperation on our recent visit to the subject property.
Sarah Summers and I discussed our observations with our supervisors, Dave Puent, Building
Official, and Gary Karp, Planner III for our department. They both agree on the following
resolution to the duplex/four-plex dilemma.
Multi-family housing (more than two dwelling units on corner lots) is not permitted in Low
Density Residential (LDR) zones. A dwelling unit is defined in the Development Code as "One
or more habitable rooms which are occupied, intended or designed to be occupied by one
family with housekeeping facilities for living, sleeping, cooking and eating."
When it is possible to readily isolate separate areas of a building, and each area is capable of
functioning as a separate unit, we must view each area' as potentially being a separate
dwelling unit.
Since you were apparently previously advised by this office to remove the locking devices on
doors connecting such areas in each unit of the duplex and to restrict separate use by your
tenants as a means of remedying the potential for multi-family use, we will honor that position
so long as you continue to own the property and use it s;lS a duplex. However, prior to selling
the property both sides of the duplex must be modified to eliminat'e th.e, potential use of the
:property as a four-plex. Some of thEfpossiDle options are to remove' the outside' door

providing access to the lower' floor area, to remove the downst~i!s kitchen' o-r bat!1ro,9m
facilities, or to modify the access-between the upstairs and downstairs in a m~nner that
cannot be easily closed off. Other p6ssiblealternatives may also exist.

From my recent observation, the building systems appeared to be in safe condition. However,
it is important for you to verify that smoke detectors have been installed in the downstairs
areas and are properly functioning, and that ground-fault circuit interrupter devices were
installed in the bathroom electrical outlet boxes.
Please contact this office before you offer the property for sale In order to determine an
