ORDINANCE NO. 5923
(REGULAR)
AN ORDINANCE AMENDING THE MID-SPRINGFIELD REFINEMENT PLAN TEXT BY
DELETING RESIDENTIAL DEVELOPMENT POLICIES 11 AND 12.
The City Council of the City of Springfield finds that:
A. Article 8 of the Springfield Development Code sets forth criteria for refinement plan text
amendments.
B. On February 12, 1999, Springwood Inc., initiated the following refinement plan amendment:
Request to delete Residential Development Policies 11 and 12 of the Mid-Springfield
Refinement Plan, 10. No. 99-02-0040. .
C. On April 20, 1999, the Springfield Planning Commission conducted a public hearing to accept
testimony and hear comments on this proposal. After the close of the public hearing the Planning
Commission considered the testimony provided, including the staff report and all materials
submitted in the application. The Planning Commission voted six in favor, none opposed, one
absent, to forward a recommendation of approval to the Springfield City Council.

D. On May 3, 1999, the Springfield City Council held a public hearing on this proposal.
E. Evidence exists within the record and the findings attached hereto that the proposal meets the
requirements of Article 8 of the Springfield Development Code.
NOW, THEREFORE, THE CITY OF SPRINGFIELD DOES ORDAIN AS FOLLOWS:
Section 1: The above findings, and the findings set forth in Exhibit A attached hereto and
incorporated herein by reference are hereby adopted.
Section 2: Residential Development Policies 11 and 12 are hereby deleted from the text
of the Mid-Springfield Refinement Plan.
Section 3: If any section, subsection, sentence, clause, phrase, or portion of this
Ordinance is for any reason held invalid or unconstitutional by any court of competent
jurisdiction, that portion shall be deemed a separate, distinct, and independent provision and that
holding shall not affect the validity of the remaining portions of this Ordinance.
ADOPTED by the Common Council of the City of Springfield by a vote of 5 for
and 0 against this 17t? day of May, 1999.
