ORDINANCE NO. 5922 (REGULAR) AN ORDINANCE AMENDING THE MID-SPRINGFIELD REFINEMENT PLAN DIAGRAM BY REDESIGNATING 6.6 ACRES OF LAND FROM MEDIUM DENSITY RESIDENTIAL TO LIGHT MEDIUM INDUSTRIAL. The City Council of the City of Springfield finds that: A. Article 7 of the Springfield Development Code sets forth the requirement for automatic amendment of refinement plan diagrams for consistency with the Metro Plan diagram. B. On February 12,1999, Springwood Inc., initiated the following Mid-Springfield Refinement Plan diagram amendment: Request to redesignate 6.6 acres of land from Medium Density Residential to Light Medium Industrial, 10. No. 99-02-0039, Tax Lot 700, Assessor's Map 17-02-31. C. On April 20, 1999, the Springfield Planning Commission conducted a public hearing to accept testimony and hear comments on this land use proposal. After the close of the public hearing the Planning Commission considered the testimony provided, including the staff report and all materials submitted in the application. The Planning Commission voted six in favor, none opposed, one absent, to forward a reco~endation of approval to the Springfield City Council. . . -. D. On May 3, 1999, the Springfield City Council held a public hearing on this proposal. . . . E. Evidence exists within therecord and the findings attached hereto that the proposal meets the requirements of Article 7 of the Springfield Development Code. NOW, THEREFORE, THE CITY OF SPRINGFIELD DOES ORDAIN AS FOLLOWS: Section 1: The above findings, and the findings set forth in Exhibit A attached hereto and incorporated herein by reference are hereby adopted. Section 2: The Mid-Springfield Refinement Plan designation of the 6.6 acres more particularly described in Exhibit B attached hereto and incorporated herein by reference, is hereby amended from Medium Density Residential to Light Medium Industrial. Section 3: If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid"or unconstitutional by any court of competent jurisdiction, that portion shall be deemed a separate, distinct, and independent provision and that hold shall not affect the validity of the remaining portions of this Ordinance.
