AN ORDINANCE REZONING LAND IN ACCORDANCE WITH THE Q STREET

REFINEMENT PLAN AND DECLARING AN EMERGENCY. :

THE CITY OF SPRINGFIELD DOES ORDAIN AS FOLLOWS:
Section 1: The Plan Diagram and Plan Implementation Policies of the Q Street
Refinement Plan (adopted March 16, 1987) determine the zoning of land within the jurisdiction
of the Q Street Refinement Plan. i
Section 2: The Findings ofthe Springfield Planning Comm,ssion, Order No. 98-11-
243 and Order No. 98-12-268 have been reviewed and are hereby adopted in support of the
rezoning ofland described in Attachment A of this Ordinance. Orders No. 98-11-243 and 98-12-
268 are attached hereto and incorporated herein by reference. i

Section 3: It is hereby found and determined that the rezoning of land as specified
in the Plan Policies of the Q Street Refinement Plan and the attached Planning Commission
Orders is a matter affecting the public health, safety and welfare and that:an emergency therefore
exists and that this ordinance shall take effect immediately upon its passage by the Council and
approval by the Mayor.

ADOPTED by the Common Council of the City of Springfield by a vote of 6 in
favor and ~ against this 15th day of March, 1999. .-

Two tracts of land located Northerly of "Q" Street between 2nd S~reet and 5th Street in
Section 26, Township 17 South, Range 3 West of the Willamette Meridian in the City of
Springfield, Lane County. Oregon, being more completely described as follows:

Beginning at the intersection of the Easterly right of way of 2nd Street with the Northerly
right of way of "Q" Street, which point bears South 890 58' 45" West 1554.58 feet and
North 000 01' 37" East 40.00 feet of the Southeast comer of the Jacob Halstead
Donation Land Claim No. 47, said point being the Northwest comer of that tract of land
described by deed from Donald L. and Virginia L. (Cramlet) Branch, James A. and
Virginia L. (Taylor) Branch, Boyd M and Charlotte Alley to the City of Springfield,
recorded August 15, 1980 on Reel 1 089R at Reception No. 8040251, Lane County
Official Records, Lane County, Oregon; thence North 000 01' 37" East 395.00 feet

2300, 2400 and 2500. These properties shall be rezoned immediately upon approval by the Planning
Commission of the Final Order. I

Timely and sufficient notice of the public hearing, pursuant to Section 14.030 lof the Springfield
Development Code has been provided. .
3. On December 1, 1998 a public hearing on the zone change request was held. The Development
Services Staff notes including criteria of approval. fmdings, and recommendations together with the
testimony and submittals of the persons testifying at the hearing have been considered and are part of
the record of this proceeding.
CONCLUSION
On the basis of this record, the requested zone change application is consistent witll the criteria of Section
12.030 of the Springfield Development Code. The general finding is supported by'the specific fmdings of
fact and conclusions in the attached staff report (Attachment A) and attached hereto.

NATURE OF THE APPLICATION
Zone change from Low Density Residential to Community Commercial for property located at
1871 2nd Street, 304 Q Street and 350 Q Street. These properties are more specifically known as
Assessor's Map 17-03-26-24, Tax Lots 1200, 1600 and 1702. .

2. The application was submitted in accordance with Section 3.050 of the Springfield
Development code. Timely and sufficient notice of the public hearing, pursuant to Section
