ORDINANCE NO. 5914 (SPECIAL) I , I AN ORDINANCE REZONING LAND IN ACCORDANCE WITH THE Q STREET I REFINEMENT PLAN AND DECLARING AN EMERGENCY. : I I THE CITY OF SPRINGFIELD DOES ORDAIN AS FOLLOWS: Section 1: The Plan Diagram and Plan Implementation Policies of the Q Street Refinement Plan (adopted March 16, 1987) determine the zoning of land within the jurisdiction of the Q Street Refinement Plan. i Section 2: The Findings ofthe Springfield Planning Comm,ssion, Order No. 98-11- 243 and Order No. 98-12-268 have been reviewed and are hereby adopted in support of the rezoning ofland described in Attachment A of this Ordinance. Orders No. 98-11-243 and 98-12- 268 are attached hereto and incorporated herein by reference. i I Section 3: It is hereby found and determined that the rezoning of land as specified in the Plan Policies of the Q Street Refinement Plan and the attached Planning Commission Orders is a matter affecting the public health, safety and welfare and that:an emergency therefore exists and that this ordinance shall take effect immediately upon its passage by the Council and approval by the Mayor. The City of Springfield has initiated the following zone change request: r Applicant - The City of Springfield, Journal Number 98-11-243. . 2. The application was submitted in accordance with Section 3.050 of the Springfield Development code. Timely and sufficient notice of the public hearing, pursuant to Section 14.030 lof the Springfield Development Code has been provided. . 3. On December 1, 1998 a public hearing on the zone change request was held. The Development Services Staff notes including criteria of approval. fmdings, and recommendations together with the testimony and submittals of the persons testifying at the hearing have been considered and are part of the record of this proceeding. CONCLUSION On the basis of this record, the requested zone change application is consistent witll the criteria of Section 12.030 of the Springfield Development Code. The general finding is supported by'the specific fmdings of fact and conclusions in the attached staff report (Attachment A) and attached hereto.
