As part of that representation, we assist the City of Springfield Department of Planning and Community Development in the enforcement of City of Springfield Nunicpal Code, and the City of Springfield Zoning Code. The City of Springfield Planning Department has informed us that they are experiencing two continuing problems with your firm arising from your failure to comply with two specific requirements of your Certificate of Occupancy. Those specific requirements are as follows: "3. The South A Street frontage shall be landscaped in compliance with the guidelines explained in the handout supplied by the City. . .". "6. Vehicles shall not displayed within the South A right of way unless written approval is obtained from the State Highway Department. If you are able to obtain such approval, all areas used for display of vehicles shall also be paved. This will require a re-submittal of a revised plan for the additional paving and modifications of the landscaped area for approval by the City prior to making such change". Staff of the Department of Planning and Community Development have informed this office that there has been some difficulty in impressing upon personnel of your office the importance of compliance with these two requirements and also that there have been numerous instances in which the requirements have not been observed. The purpose of this letter is to make clear to you the City's determination that these two requirements be observed. In the event that they are not observed, this office has received instructions to initiate appropriate civil legal proceedings to .~ \ . . -. . November 4, 1985 Page 2 compel your compliance. We hope that this will not be necessary, however, please do not underestimate the City's resolve and determination that the South A Street frontage shall be landscaped and that absent any approval by the State and the City, vehicles shall not be displayed within the South A right of way. Should you fail to comply with the requirements as specified above at any time after your receipt of this letter, please be informed that this matter will be referred to the City Prosecutor with the recommendation that appropriate civil proceedings be initiated in the Springfield Municipal Court to compel your compliance.
