The city of Springfield hereby grants to Les' Service
Center, hereinafter Permittee, permission to use and encroach
.,
upon a portion of a 12-foot wide drainage easement on the property
known as 255 South "A" Street, more particularly described as
Lane County Assessor's Map No. 17 03 35 32, Tax Lot No. 7300
and shown on the map attached 'hereto as Exhibit "A", upon the
following terms and conditions:
1. This permit nay be revoked at any time by the City
of Springfield. The need for such revocation shall be determined
through the sole and unrestricted discretion of the City of
Springfield.
2. In the event of such revocation, Permittee shall remove
at Permittee's sole cost and expense an~ and all encroachments
placed on the drainage easement net later than 30 calendar days
after receiving demand ror such removal from the City.
3. The use and encroachment permitted shall consist solely
of a ls-foot by ls-foot addition to the east end or the existing
structure. Permittee shall comply with all applicable state and
local laws, ordinances and policies while using and encroaching
upon the public easement.
4. Permittee shall provide City w,ith right of entry and
convenient means of access to maintain the City's storm sewer.
Permittee further agrees that in the event the City's storm sewer
needs repair or replacement, the Permittee will either immediately
remove the encroachment, at Permittee's sole cost, or provide at

C~ty all necessary easements and pay all costs
of rerouting the storm sewer around the encroachment.
5. Permittee shall defend, indemnify and hold harmless
City from and against any and all liability to all persons and
against any and all liability claims arising from personal injuries
or property damage which might be occasioned by permittee's use
of the public easement as herein described.
6. If revocation by the City in accordance with paragraph 1
has not occurred by January 1, 2001, this permit shall terminate,
be null and void and of no further force and effect. It is
specifically understood that this termination date specified
herein does not diminish the rights which the City has pursuant
to paragraph 1 of this agreement.
