HomeMy WebLinkAboutResolution 2014-39 12/01/2014CITY OF SPRINGFIELD RESOLUTION NO. __2014-39 A RESOLUTION OF THE CITY OF SPRINGFIELD COMMON COUNCIL ADOPTING A LIST OF CAPITAL IMPROVEMENTS TO BE FUNDED BY TRANSPORTATION SYSTEMS DEVELOPMENT CHARGES, AND SETTING AN EFFECTIVE DATE WHEREAS, on December 1, 2014, the City adopted a methodology to be used for setting rates for Transportation Systems Development Charges; and WHEREAS, ORS 223.309 (1) and (2) provide that a City shall base an Improvement fee on a capital improvement plan or project list; and WHEREAS, the City Council, on March 11, 2014, adopted a Local Transportation System Plan setting forth a list of capital projects required to meet the needs of development; and WHEREAS, the City Council has also adopted a Capital Improvement Plan which includes additional projects which are reasonably required to provide transportation service to areas within the existing urban growth boundary; and WHEREAS, the City Manager has recommended that for purposes of ORS 223.309 (1) and (2) a list of projects upon which Transportation Systems Development Charges should be based, derived from all of these sources should be adopted; and WHEREAS, a citizen advisory committee appointed by the Council has considered the methodology currently in use by the City and has recommended certain changes thereto and, in the course of such review, recommended that the Council direct staff to provide more frequent regular updates to capital project lists used to determine Systems Development Charges; and WHEREAS, the list of Capital Improvements to be funded by Transportation SDCs is attached as Exhibit B; and WHEREAS, the City Manager has provided the Council with such list, a true copy of which, bearing date of August 20, 2014, is attached hereto, and by this reference incorporated herein; and WHEREAS, subsequent to the adoption of the Capital Improvements List, Council will consider adoption of a resolution adopting a Transportation System Development Charge; and WHEREAS, the City duly gave notice in accordance with ORS 223.309 (2)(a) that on October 20, 2014, the first public hearing was to be held on the matter of the adoption of the project list and did, on said date, open and conduct a public hearing; and WHEREAS, the hearing and the record were held open for further testimony and public comment at the December 1, 2014, City Council meeting; and WHEREAS, the Council has considered the report and recommendation of the Citizen Advisory Committee, the report and recommendation of the City Manager, and the testimony at the public hearing; and WHEREAS, nothing herein shall affect, modify or amend the provisions of Section 3.400 through 3.420 of the Springfield Municipal Code; and WHEREAS, the Council having considered all of the testimony and facts, and being well-advised in the premises, finds and determines that it is in the public interest to modify the project list upon which Transportation Systems Development Charges should be based: NOW, THEREFORE, BE IT RESOLVED, that the Transportation System Development Charge Project List attached as Exhibit "A" is hereby adopted; and BE IT FURTHER RESOLVED, that nothing herein shall affect, modify or amend the provisions of Section 3.400 through 3.420 of the Springfield Municipal Code; and BE IT FURTHER RESOLVED, that this Resolution shall take effect upon adoption by the Council and approval by the Mayor.
