MINUTES OF THE EMERGENCY REGULAR SESSION
OF THE SPRINGFIELD CITY COUNCIL
HELD ON MONDAY, SEPTEMBER 24, 2001
The Springfield City Council met in Emergency Regular Session at Springfield City Hall, Jesse
Maine Meeting Room, 225 Fifth Street, Springfield, at 7: 10 p.m., with Mayor Leiken presiding.
ATTENDANCE
Present were Mayor Leiken, and Councilors Ballew, Fitch, Hatfield, Lundberg, Ralston and
Simmons. Also present were Assistant City Manager Gino Grimaldi, City Recorder Kim Krebs,
City Attorney Joe Leahy, City Attorney Tim Harold, Police Chief Jerry Smith, and members of
staff.
,1. Ballot Title - 2001 Springfield Charter.
City Attorney Joe Leahy circulated a copy of proposed amendment to the Ballot Title (Exhibit A)
related to the November 6, 2001 Charter Election. He said the council held discussions regarding
this amendment in the Executive Session meeting held earlier this evening. He said if endorsed
by the Court would settle the litigation Simmons versus City of Springfield. He said with City
Council approval, this would be presented to the Court.
IT WAS MOVED BY COUNCILOR HATFIELD WITH A SECOND BY COUNCILOR FITCH
TO GRANT LEGAL COUNSEL THE AUTHORITY TO PRESENT THE REVISED BALLOT
TITLE, "EXHIBIT A" TO THE COURT ON WEDNESDAY, SEPTEMBER 26, 2001. THE
MOTION PASSED WITH A VOTE OF FIVE IN FAVOR AND ONE ABSTAIN (SIMMONS).
Mr. Leahy responded to questions of Councilor Simmons related to the revisions.
ADJOURNMENT
The meeting was adjourned at 7: 13 p.m.
