MINUTES OF THE REGULAR SESSION OF TIiE SPRINGFIELD CITY COUNCIL HELD ON MONDAY, SEPTEMBER 17,2001 The Springfield City Council met in regular session at Springfield City Hall, Council Meeting Room, 225 Fifth Street, Springfield, on Monday, September 17,2001, at 7:07 p.m., with Mayor Leiken presiding. ATTENDANCE Present were Mayor Leiken, Councilors Ballew, Fitch, Hatfield, Lundberg, Ralston, and Simmons. Also present were City Manager Mike Kelly, Assistant City Manager Gino Grimaldi, City Attorney Tim Harold, City Recorder Kim Krebs, Police Chief Jerry Smith, Finance Director Bob Duey, and members of staff. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Mayor Leiken. Mayor Leiken said in Remembrance for the Victims of the Terrorist Attacks on September 11, 2001, he read the following letter: In the Wake of overwhelming catastrophe, our city, along with those around the world mourn those that have suffered disastrous losses. We share in the grief of our nation and its people. . While terrorism tries to bread down our way of life, it will not be successful. We as Americans are a united family. Our city will come together, with the nation, and we will not be broken. We are a strong people, we recognize what has happened, we will continue to stand tall, be free, we are Americans. Together, we are an America that is rebuilding our homeland, one day at a time, beginning this 17th day of September 200 I. SPRINGFIELD VPBEA T 1. Mayor Leiken recognized Lee Beyer in Recognition for his years of dedicated service to the City of Springfield. 2. City Manager Mike Kelly recognized Brad Sargeant, Springfield Library for 15 years of service to the City of Springfield. 3. Larry King, Springfield Lions Sight and Hearing Foundation, presented a grant check to Library Director Bob Russell in the amount of $2000. Mr. Russell said the funds would be used to purchase software that would enable visually impaired citizens by using a computer; to scan a document and have the computer read the document back in an audible voice. . Presentation of a gift from the Mayor of Palmers ton North, New Zealand to Mayor Leiken, by Ron Sauer, Springfield Young Life Coordinator. 5. Mayor Leiken Proclaimed the Month of October 200 I, as Disability Employment Awareness Month. CONSENT CALENDAR. Community Development Block Grant (CDBG) Funding Support for Lane County Child Advocacy Center (CAe) Relocation and Expansion. Housing Program Specialist Kevin Ko was present for the staff report. He said theCAC has requested that the City of Springfield contribute $75,000 to assist with the relocation and expansion of a new regional facility on Centennial Blvd., in Eugene. He said on July 2, 2001, council directed staff to initiate the public notification process that would allow the city to provide $75,000 of CDBG program support to the CAC. He said the recommended schedule for CDBG funding is for $37,500 be allocated from the FY 2002-03 CDBG grant, and for $37,500 be allocated from the FY 2003-04 CDBG grant. He said the public hearing scheduled for tonight is the final step of the public notification process. . Mayor Leiken opened the public hearing. . . . IT WAS MOVED BY COUNCILOR HATFIELD, WITH A SECOND BY COUNCILOR FITCH, TO APPROVE CDBG ALLOCATION OF $37,500 FROM FY 2002-03 CDBG FUNDS, AND $37,500 FROM FY 2003-04 CDBG FUNDS FOR THE CHILD ADVOCACY CENTER. THE MOTION PASSED WITH A VOTE OF 6 FOR AND 0 AGAINST. 2. Asset Forfeiture Ordinance. Police ChiefJerrySmith was present for the staff report. He said this is the fIrst reading of the ordinance, and highlighted the discussions council had in it's work session meeting held earlier in the evening regarding the issue. Mayor Leiken opened the public hearing. No one appeared to speak. Mayor Leiken closed the public hearing. BUSINESS FROM THE AUDIENCE 1. Paul Engle. 1667 N. 18th Street. Springfield. He said he is retired senior foreign service offIcer. He said he has served in most of the embassy's that have been attacked by terrorists over the last 30 years. He said his daughter-in-law grew up in SpringfIeld, and always had the dream of opening a business of her own. He said they opened for business 6 months ago. He said despite the events of last week, and the nice tribute from the Mayor earlier, he realizes that the city is returning to the critical issues of government. He said one of the issues is small business development in Springfield. He said the subject of his concern is the Sign Code restrictions, and how difficult those restrictions make it for small businesses to attract customers. He said the city staff has already assisted him in research of the origin of the Sign Code, in particular the A-frame sandwich boards. He said he and his daughter-in-law were unaware ofthe restriction until he received a citation, and a threat of a $150. per day fme. He said his business dropped approximately 50% when they removed those signboards. He said he understands from talking to staff that sometime in November the council will be reviewing some revisions to the sign codes, and hopes that he has an opportunity to offer some input into the revisions. 2. Steve Stermer 816 Raintree Way. SpringfIeld. He said he is the Principal of Agnes Stewart Middle School, and member of the SpringfIeld Museum Board. He said it has been a very busy summer at the SpringfIeld Museum, and wanted to share those events. He highlighted the various events, and thanked the Mayor and City Council for allowing him to share this information, and said it is a delight for him to be able to serve on the Springfield Museum Board. Councilor Ballew said she has heard many positive remarks about the current Fishing Exhibit in the SpringfIeld Museum, and complimented the Museum on their choice of exhibits. Springfield City Council Regular Session - September 17, 200 I Page - 4 . CORRESPONDENCE AND PETITIONS 1. Correspondence from Raymond Broderick, Director Child Advocacy Center of Lane County, and F. Douglas Harcleroad, President Friends of the Child Advocacy Center Board of Directors, Regarding the City of Springfield's pledge of support ofthe CDBG funding for the Child Advocacy Center. MOTION: IT WAS MOVED BY COUNCaOR HATFIELD WITH A SECOND BY COUNCaOR FITCH TO ACCEPT THE CORRESPONDENCE FROM THE CHaD ADVOCACY CENTER OF LANE COUNTY FOR FaING. THE MOTION PASSED WITH A VOTE OF 6 IN FAVOR AND 0 AGAINST. BIDS ORDINANCES 1. Second Reading and Adoption of TransPlan and Related Metro Plan Amendments. ORDINANCE NO. 5990 - AN ORDINANCE AMENDING THE EUGENE-SPRINGFIELD METROPOLITAN AREA GENERAL PLAN TO ADOPT A REVISED "TRANSPORTATION ELEMENT" AND RELATED CHANGES TO THE PLAN TEXT; ADOPTING REVISIONS TO THE EUGENE-SPRINGFIELD TRANSPORTATION SYSTEM PLAN (TRANSPLAN); AND ADOPTING A SEVERABILITY CLAUSE. . Traffic Manager Nick Amis and Planning Manager Greg Mott were present for the staff report. Mr. Mott said for information purposes only, the first public hearing was held on this item on October 19, 1999. Mr. Amis said tonight the Council is requested to adopt the TransPlan Ordinance, the Transportation Element (exhibit A), the Findings (exhibit C), and also the document from the Land Conservation Development Commission, which are the alternative performance measures. He said the informatiori. contained in this document is what staff will be working on for the next few years, and highlighted that work. He said by adopting TransPlan that will include the Errata sheet that is included in TransPlan. Councilor Hatfield asked if the errata and David Kelley's amendment are part of this motion? Mr. Arnis said he would suggest that the motion include the acceptance of all errata. Councilor Hatfield said he watched the Eugene City Council meeting where David Kelley made an amendment that included a discussion of a corridor study along 1-5, and it was agreed that there would not be a corridor study unless the environmental impact statement of Beltline 1-5, not Beltline 1-5 as it is currently configured. He said the reasoning behind that is they don't want a corridor study to slow down Beltline 1-5, and MPC metro partners agreed with that. That is why David Kelley added that language into his motion. . Mayor Leiken said the current City Council has provided terrific leadership throughout the TransPlan process. He said Councilor's Hatfield and Ballew have provided terrific leadership on MPC, and said that Councilor Ballew held strong to the needs of this community and the region Springfield City Council Regular Session - September 17, 2001 Page - 5 . as well. He said Councilor Hatfield has probably been looking at the issues of TransPlan for approximately six years. He thanked all the members of the Council and staff for their outstanding leadership and hard work. IT WAS MOVED BY COUNCILOR HATFIELD, WITH A SECOND BY COUNCILOR BALLEW, TO ADOPT ORDINANCE NO. 5990 INCLUDING ALL ERRATA. THE MOTION PASSED WITH A VOTE OF 6 FOR AND 0 AGAINST. Tom Schwetz, Lane Council of Governments (LCOG) said he has nothing specific about TransPlan, and said he wanted to make an observation that he shared with the other groups. He said nine years is a long time, and he looked back over his own life during this period, he briefly highlighted the changes that have happened to him in his personal life over these past years. He said based on the many changes in his life, his observation is that things do not always go as they are planned, however given the changes in life that we all experience, it is good to have a Plan to work from. He said he looks forward to the implementation of TransPlan. BUSINESS FROM THE CITY COUNCIL 1. Special Library District. Councilor Ballew said there would be a work session scheduled very soon regarding the possibility of created a Special Library District. . 2. Metropolitan Policy Commission (MPC). Councilor Hatfield said at the recent MPC meeting a recommendation was forwarded to the Lane County Board of Commissioners a list of local projects for HB 2142 funding, and said number one on that list with a request of $35,000 million, is Phase 1- Beltline/I-5, and item number three is a request of $3.3 million for the Pioneer Parkway Extension (PPE). 3. Human Services CommissionIHousing Policy Board. CouncilorLundberg said the two Boards met in a joint meeting last week, and made some progress in terms of realization that housing projects and social services have to go hand in hand, and exploring the idea of working jointly on projects. 4. Watershed Council. Councilor Simmons said at the meeting last week there was discussion regarding the BP A group holding it's annual meeting here in Springfield next year. He said that would provide them an opportunity to see some of the projects on the ground in the McKenzie Basin. He said the contract for the Education Coordinator has been renewed, and there is a lot of activity related to grant writing. He said there are many opportunities for us to obtain funding in certain areas, as well as the Oxbow part of the river. 5. Bus Rapid Transit (BRT). Councilor Fitch said the BRT Steering Committee met this month, and said the corridor for the Pioneer Parkway Extension will be presented to the Planning Commission, and then on to the City Council, in order to solidify our previous joint meeting with the Lane Transit District. 6. Mayor Leiken said tomorrow September 18, 200 I, is the first anniversary of his being sworn in as Mayor for the City of Springfield. . ~ Springfield City Council Regular Session - September 17, 200 I Page - 6 .
