MINUTES OF THE REGULAR SESSION OF THE SPRINGFIELD CITY COUNCIL HELD ON MONDAY, MAY 21, 2001 The Springfield City Council met in Regular Session on Monday, May 21,2001 at Springfield City Hall, City Council Meeting Room, 225 Fifth Street, Springfield, at 7:01 p.m., with Mayor Leiken presiding. ATTENDANCE Present were Mayor Leiken, and Councilors Ballew, Fitch, Hatfield, Lundberg, Ralston and Simmons. Also present were City Manager Mike Kelly, Assistant City Manager Gino Grimaldi, City Recorder Kim Krebs, City Attorney Joe Leahy, Police Chief Jerry Smith, and members of the staff. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Mayor Leiken. SPRINGFIELD UPBEAT 1. City Manager Mike Kelly recognized Kathy Jensen for 15 years of service to the City of Springfield. 2. RESOLUTION NO. 01-35 - A RESOLUTION INITIATING EXTRATERRITORIAL ESTENSION OF A WATER LINE AND ANNEXATION OF CERT Am TERRITORIES TO THE CITY OF SPRINGFIELD AND REQUESTING THAT THE LANE COUNTY LOCAL GOVERNMENT BOUNDARY COMMISSION APPROVE THE ANNEXATION AND EXTRATERRITORIAL EXTENSION OF THE WATER LINE. Planner Colin Stephens was present for the staff report. He said this request is for approval of the resolution recommending that the Boundary Commission approve the annexation of approximately 22 acres of Mountain Gate, a 330-acre residential development. He said the area went through an elaborate master planning process a number of years beginning in 1994, and then gained final approval in 1998. He said during the master planning process, city staff and staff of the many agencies that provide services to this are, reviewed the request and determined that there are key urban services available to service this entire site. He said the request before council now is for only 22 acres of that site. He said Article 6 of the Springfield Development Code authorizes the Council to recommend approval of annexation if those key urban services are available. He said since this does comply with Article 6, staff recommends approval of the resolution. Councilor Ballew asked what made this an extraterritorial extension of the water line? Mr. Stephens said there is a 16-inch water line on South 67th Street, which has the capacity to serve the entire development area. He explained where the sewer lines were, and highlighted how those lines would service future phases of the Mountain Gate area. He said what is before council tonight will service Phases I and II. Proposed Resolution Setting Local and Regional Sewer User Fees. RESOLUTION NO. 01-36 - A RESOLUTION OF THE CITY OF SPRINGFIELD COMMON COUNCIL SETTING LOCAL AND REGIONAL SEWER CHARGES AS SET FORTH IN THE SPRINGFIELD MUNICIPAL CODE. Environmental Services Supervisor Gary Colwell was present for the staff report. He said the action before council is to request adoption of the schedule of rates of new sanitary sewer and local and regional drainage rates to go into effect on July 1, 2001. He said council is requested to adopt the regional rates because the Metropolitan Wastewater Management Commission approved a 5% rate increase, and the IGA between MWMC and Springfield obligates the City to adopt at least as high a rates as the commission approves. He said council discussed this in their March work session, and staff proposed several options for increasing revenue for capital services, and council chose to increase revenue by approximately $700,000.,. He said a public open house was held, and there has been no negative comments to the proposed increases. Mayor Leiken opened the public hearing. No one appeared to speak. . AND DECLARING AN EMERGENCY. Accounting Manager Valerie Nardo was present for the staff report. She said this local improvement district includes 19 properties on J Street between 21 st and 25th and lies within the city limits. She said the city has completed the project, and is bringing this before council to request adoption of the ordinance assessing the properties for this project in the amount of$163,475. She said the ordinance contains an emergency clause that makes it effective immediately, and said the emergency clause is being used because staff would like to enter the liens on the City docket as soon as possible. Councilor Ralston asked about the information contained in the Council Briefing Memorandum and wondered why some residents have a -0- next to their name. Ms. Nardo said what that means is the income level for the owner makes them eligible for full CDBG subsidy, however it does not increase the amount that the other residents pay. City Attorney Joe Leahy said the items relating to Home Depot will be placed in the Home Depot record maintained by the Planning Department. Councilor Simmons asked if all the items listed that relates to Home Depot received prior to the deadline. Mr. Leahy said yes the items listed tonight were received prior to deadline. The items that were received after the deadline he will recommend that council accept them in the normal course, but will not be placed \ in the Planning record. BUSINESS FROM THE CITY COUNCIL Mayor Leiken thanked Councilor Hatfield and Ballew for their leadership and service at the Metropolitan Policy Committee, especially during the TransPlan discussions. He said they both are to be commended for their dedicated service, and he appreciates their contribution. Councilor Ballew said she and Len Goodwin will be having the agreement signed by the provisioner to light the Fiber for both Consortiums. Councilor Ralston said at the LRAPA meeting there was discussion regarding the possibility of bringing litigation against Monaco Coach. He said he voted against that option. Councilor Simmons said the Watershed Council had a briefing as it relates to the Oxbow Master Plan, and also from the Army Corp of Engineers advising that is may be one of the driest season on record. Mayor Leiken said this week is the 75th Anniversary of Brattain Elementary School. He said he attended the celebration. Mayor Leiken said on Memorial Day there will be an event held at Springfield Memorial Gardens. / BUSINESS FROM THE CITY MANAGER 1.
