CITY OF SPRINGFIELD, OREGON
RESOLUTION NO. 01-62
.
WHEREAS, the Common Council of the City of Springfield authorized the assessment of a lien on the property
listed on Exhibit "A", attached herein, by Resolution #01-2 on January 26, 2001;
WHEREAS, on June 8, 2001 the city held a foreclosure sale pursuant to ORS 223.505 - 223.650 and the property
listed on Exhibit "A", attached herein, was purchased by the City for a sale price of $1 ,424.43 and a Certificate of Sale
was recorded at Lane County Deeds and Records, Recording #2001-035280,
WHEREAS, on June 16, 2001 the city was notified that the property owner had filed bankruptcy on March 26,
2001, and, therefore, a Release of Certificate of Sale was recorded at Lane County Deeds and Records, Recording #2001-
051671 to release the City's interest in the property,
WHEREAS, the assessed charges, and related foreclosure costs, remain delinquent and no payment has been
made on the obligation;
WHEREAS, the property owner and his attorney has been notified concerning the proposed reinstatement of lien
on the property, plus related foreclosure costs, described on the attached Exhibit "A";
WHEREAS, a public hearing to be held by the Common Council of the City of Springfield on October 1,2001
. was continued to November 5,2001 giving said property owner an opportunity to object to the proposed reinstatement of
assessment lien, plus related foreclosure costs;
WHEREAS, it is the intention of the Common Council of the City of Springfield to reinstate a lien on the
property for the grass and weeds cutting charges, plus related foreclosure costs, so described under the authority of the
Springfield Municipal Code and the Uniform Fire Code (Appendix II-P).
NOW THEREFORE BE IT RESOLVED, that the Finance Director of the City of Springfield should be, and is
hereby directed to immediately reinstate to the lien docket the grass and weeds cutting charges, plus associated
foreclosure costs, upon the property described on the attached Exhibit "A".
