RESOLUTION NO 01-61 A RESOLUTION INITIATING AN EXTRATERRITORIAL WATER LINE EXTENSION TO TERRITORY OUTSIDE THE CITY OF SPRINGFIELD AND WITHIN THE METRO PLAN URBAN GROWTH BOUNDARY AND REQUESTING THAT THE LANE COUNTY LOCAL GOVERNMENT BOUNDARY COMMISSION APPROVE THE EXTENSION IN A PUBLIC HEARING. WHEREAS, the City Council is authorized by ORS 199.464 to initiate the extension of municipal water service beyond the city limits and has received a petition for extension by the property owners, and WHEREAS, the City finds that water service is needed to alleviate a shortage of potable water in the territory, and WHEREAS, the property owners of the territory (Exhibit A) proposed to be served by the water service have signed and recorded annexation agreements agreeing to annex their properties to the City at such time as the City deems necessary pursuant to Metro Plan policies 20 and 21 on page II-B-7, and WHEREAS, water service can be provided in a timely manner by the Springfield Utility Board via a 12 inch water main currently abutting the subject territory within the right of way of Main Street (Highway 126) and located approximately 800 feet west of the intersection with South 79th Street, and WHEREAS, the territory to be served is within the Eugene-Springfield Urban Growth Boundary and abuts the city limits (Exhibit B); and WHEREAS, the subject territory can not be provided with a full range of key urban services specifically sanitary sewer and storm drainage as required by Metro Plan policy 8 on page II-B-5, and WHEREAS, available sanitary sewer service planned for this area is approximately 3,000 feet west of the boundary of the subject territory and extension of the sewer main is not listed in the City's 5 year Capital Improvement Program, and WHEREAS, there is no storm drainage capacity downstream from the subject territory and no drainage infrastructure or improvements within the boundaries of the subject territory, and WHEREAS, the City has no immediate remedy for the lack of drainage capacity and no projects planned or funded to resolve the deficiency in the system, and WHEREAS, the lack of sanitary sewer and storm drainage capacity will require the City to limit division of land and development in the territory until such time as capacity is made available, and WHEREAS, prior to the Boundary Commission public hearing on this matter each property owner shall execute and record a restriction against their property prepared by the City Attorney specifying that no land division may occur until sanitary sewer and storm water capacity is made available to the property. NOW THEREFORE THE CITY OF SPRINGFIELD DOES RESOLVE AS FOLLOWS: Section I: The Common Council of the City of Springfield does hereby recommend approval of the extraterritorial extension of water to the subject territory by the Lane County Local Government Boundary Commission, Lane County, Oregon, said territory being depicted in Exhibit A of this Resolution.
