HomeMy WebLinkAboutOrdinance 6327 10/06/2014ORDINANCE NO. 6327 (GENERAL) AN ORDINANCE AMENDING CHAPTER 6 VEHICLES IN TRAFFIC SECTION 6.020 "RESTRICTED IN TIME" AND SECTION 6.335 "ABANDONED VEHICLES — DEFINITION" OF THE SPRINGFIELD MUNICIPAL CODE AND ADOPTING A SEVERABILITY CLAUSE The City Council of the City of Springfield finds that: WHEREAS, car sharing offers citizens an additional choice when making decisions regarding modes of travel; and WHEREAS, car sharing is a mode of car rental wherein citizens may rent cars for short periods of time to be used in and around the Springfield/Eugene area; and WHEREAS, car sharing, leasing, and rental cars provide the opportunity for individuals to gain the benefits of access to private cars without the cost and responsibilities of actual ownership; and WHEREAS, the use of shared, leased, and rental vehicles is seen to lend to a decrease in roadway congestion; and WHEREAS, the City wishes to encourage such car sharing by permitting car sharing, leased and rental vehicles to be allowed to park on street without time limit in legal and not otherwise restricted parking spaces; and WHEREAS, the City has available parking spaces that may be used for such car sharing, leased and rental vehicles; and WHEREAS, the City recognizes the need to encourage, and provide opportunities for car sharing, leased and rental vehicles for the benefit of the citizens of Springfield. NOW, THEREFORE, THE CITY OF SPRINGFIELD DOES ORDAIN, AS FOLLOWS: Section 1: Section 6.020 "Restricted In Time" of the Springfield Municipal Code is hereby amended to read as follows: "6.020 Restricted In Time. (1) No person shall park a vehicle in a parking zone, whether on the street or in a municipal parking lot, for a period in excess of the period of time designated for parking in the zone, except as provided in subsection (2) of this section. Where maximum parking times are designated, movement of a vehicle within a block shall not extend the time limits for parking. (2) Parking permits may be issued that shall entitle the vehicle, upon which the permit is placed, to park in excess of the time limits provided in a restricted time space. Permits shall be issued as follows: (a) The city manager may issue "visitor" parking permits for persons attending meetings, conferences, performing volunteer work, conducting construction or repair or at the manager's discretion. (b) The municipal court may issue "jury" parking permits for persons performing jury duty. (c) The public works department, or traffic department, may issue "special" parking permits for construction and maintenance vehicles, equipment, materials, or to businesses or homeowners adjacent to street construction projects, whenever the construction necessitates the permits. (d) The city manager may authorize approved entities to park "fleet" or car sharing, leased and rental vehicles on street in excess of posted time -stays. (3) Permits shall be valid only for the dates specified, or if no date is specified, until revoked. (4) Permits shall be placed on the dash of the vehicle so as to be plainly visible from outside the vehicle. (5) Nothing herein shall be construed as allowing any vehicle to be operated or parked in any manner in violation of law or any parking requirement of Chapter 6 excepting only the specified limits of time. (6) When a vehicle is parked continuously for eight hours in an area in violation of sections 6.005 to 6.075, the vehicle may be removed by a police officer, or patrol community service officer. The impoundment and disposition shall be in accordance with the provisions of this chapter." Section 2: Section 6.335 "Abandoned Vehicles - Definition" is hereby amended to read as follows: "6.335 Abandoned Vehicles - Definition. Except as may be permitted in Springfield Municipal Code Section 6.020, a vehicle is abandoned if it is parked or placed on any street, alley, highway or other public way for a period of more than 48 consecutive hours." Section 3: Severability Clause. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is, for any reason, held invalid or unconstitutional by a court of competent jurisdiction, such portion shall be deemed a separate, distinct and individual provision and such holding shall not affect the validity of the remaining portion hereof. ADOPTED by the Common Council of the City of Springfield this 6 day of October , 2014, by a vote of 4 for and O against.
