HomeMy WebLinkAboutOrdinance 6326 10/06/2014ORDINANCE NO. 6326 (SPECIAL) AN ORDINANCE RESCINDING VACATION ORDINANCE NO. 6213 The Common Council of the City of Springfield finds that: WHEREAS, on January 22, 2008, the Springfield City Council adopted Vacation Ordinance No. 6213 vacating a segment of 181h Street north of Q Street; and WHEREAS, the vacation action was initiated by request of an adjacent property owner to facilitate development of a commercial site; and WHEREAS, a Condition of Vacation Ordinance No. 6213 is the provision that the five adjacent parcels under common ownership are consolidated with the vacated right-of-way into a single development site; and WHEREAS, there was no compliance with the condition requiring consolidation of the five adjacent lots under common ownership; and WHEREAS, in fact, the commercial development project was apparently subsequently abandoned and one or more of the adjacent properties were foreclosed and sold to multiple property owners; and WHEREAS, the vacated segment of 18th Street is not a viable, developable parcel on its own and must be reinstated and affirmed as public right-of-way to ensure legal and physical access is maintained for all the adjacent properties. NOW, THEREFORE, based on the foregoing recitals, the City of Springfield does ordain as follows: Vacation Ordinance No. 6213 is hereby rescinded and declared null and void. ADOPTED by the Common Council of the City of Springfield this _ 6 day of october 2014 by a vote of 4 for and 0 against.
