Staff have visually inspected the property at this address and believe that a violation is occurring. Rather than issue a citation or taking immediate legal action, we wish to provide you with an opportunity to correct the violation before any penalties are incurred: SPECIFIC VIOLATION: This property is located in the City of Springfield's Urban Growth Boundary. As such, the City has jurisdiction for land use and building safety issues in the UGB. The City therefore regulates fence standards and accessory structure setbacks in the UGB. Section 3.2-215 Base Zone District Standards - of the Springfield Development Code. The City received a complaint about a structure erected on the east side of the property within the required building setback . Setbacks vary depending upon the type/use of different structures. The minimum required setback is 3 feet for an accessory structure not used as a garage/carport or habitable space. (Building permits are required for accessory structures in excess of 200 square feet and/or 10 feet in height.) The complaint involved a structure built to the property line with gutters installed. (Photos are examples, not necessarily including of all violations at a site) REQUIRED CORRECTION: All accessory structures must meet required minimum setback standards. Please contact Planning Staff to discuss the use of the structures and to obtain the information necessary to relocate/alter the structure to comply with minimum residential setback standards. Planning staff are also available Monday through Friday, 8a.m. —noon and 1 p.m. — 3 p.m. in the office. • After obtaining the required setback information, contact Building staff to determine if a building permit is required. • Alter or remove structures to comply with setbacks/building permit requirements In order to avoid actions being taken against you or your property we encourage you to proceed before the deadline for compliance identified below. In the event that you have not taken corrective action by the assigned time deadline, a civil infraction citation will be issued to the resident and/or property owner requiring you to appear in Municipal Court. A finding by the Court that a Civil infraction has occurred can result in a fine of as much as $500.00 for the first offense or up to $1000.00 second or subsequent offense. The Code provides that each day a violation continues constitutes a separate offense, so penalties can increase rapidly if a violation is not corrected.
