At the Board of Appeals Meeting held on July 9, 1996 The Board of Appeals rendered the following decision regarding the above referenced variance request: . . RollCall: Present were Butch Baird, Chairperson; Jim Ingram, Orville Tharp, and Tom Miller. Ainslie Krans was absent. Staff: Dave Puent, Lisa Hopper. Secretary to the Board 2. Orville Tharp moved to approve the minutes of the April 22, 1996 Board of Appeals Meeting. Jim Ingram seconded the motion. The motion passed unanimously. 3. New Business: Chairperson Baird asked the Board to declare any conflicts of interests prior to the hearing. No conflicts were stated. n (htewnv M.aJ.1 Partners. Oregon. 11le applicant requests a var.iance from Section 9-7-14 (2) of the Springfield Sign Code relative to the placement of a freestanding sign on an undeveloped parcel in a Community Commercial zone. Lisa Hopper presented the staff report to the Board saying that tile applicant is proposing to install a freestanding sign on the last vacant pad site on tile Gateway Mall property. 111e proposed sign meets all size and hcight requirements. but the Code prohibits the placement of a sign on an undeveloped parcel of property. Ms. Hopper stated the Mall Partnership is requesting an agreement with the City of Springfield to install the allowable freestanding sign for the vacant pad site at this time with the understanding that once the pad site is improved, an additional freestanding sign would not be allowed, Ms. Hopper also said that the applicant is also agreeable to the removal of the mall entrance monument sign on the south east entrance to tile property in order to obtain a variance to place this requested freestanding sign. Ms, Hopper added that staff supports the applicants request due to the unusual visual conditions associated witil the property relating to tile placement of the new retail structure on the south west comer of the Mall property. She said that vehicles traveling south on Gateway Street will be unable to locate the new structure because of the height and location of the existing structures and landscaping located on the property. Chairperson Baird asked for clarification why this request needed to be presented to the Board. Ms. Hopper said that the Code does not allow staff to issue permits on undeveloped parcels. . . Board of Appeals Minutes July 9, 1996 Page 3 ,'interpretation of the definition is an area which is improved as one development area. Ms. Hopper said there are a number of developments in the City that incorporate two or more tax lots and each of those development areas have been allowed signage for one development area as it applies to their specific sign district. Ms. Hopper said that staff could find no unusual conditions associated with the property and that there were other alternatives for identification of the business. wall signage for example, Ms. Hopper said that staff recommends denial of the request. Stephanie Castle of Eugene Sign and Awning represented the applicant. Ms. Castle said that by reading the definition of development area in the Sign Code, they felt they were Clltitled to two freestanding signs since the business docs span two tax lots. She added that the existing signage does not exceed the allowable signage for that district. Ms. Castle added that directional signs as allowed by the Sign Code would not meet their needs because of the maximum size and height limitations. Scott Bocci of C & E Rentals and Sales was also present to offer additional information to the Board. Mr. Bocci said that the current wall signage on the building is visible only during certain times of the year. During the Spring and Summer, the street trees which have been planted along South A Street block the wall signage to oncoming traffic. Mr. Bocci expressed concern to the Board of his difficulties he has encountered during his recent improvement of his business and felt frustrated that the sign he wishes to install would not be approved by staff but had to be presented to the Board. Buzz Blumm, also representing Eugene Sign and Awning. added that the proposed location of the additional freestanding sign would only be seen from South A Street and will not be visible from where their other freestanding sign is located on Main Street. Mr. Bocci said that the property previously had a freestanding sign and ifhe would not have removed it he could have changed the copy of the sign and maintained two freestanding signs for . his business. Chairperson Baird closed the public hearing. Tom Miiler said that he felt the definition in the Sign Code was clear and the applicant is entitled to an additional freestanding sign. Dave Puent said that when a development area incorporates two or more tax lots, the property owner nonnally consolidates the tax lots into one. In this case, the lot consolidation was not made. Chairperson Baird said he agrees with Mr. Miller and that with the property having two major entrances, one from Main Street and one from South A Street. the property docs need additional sign age on South A Street. Mr. Ingram asked Mr. Bocci to specit)> the location of the proposed sign. Mr, Bocci said that the sign will be placed in the south east comer of the tax lot. meeting all minimum setbacks as required by tile City. Chairperson Baird asked Mr. Bocci if this variance was approved would they be willing to remove an existing wall sign. Mr. Bocci said that the sign above the showroom would be removed. . . Board of Appeals Minutes July 9. 1996 Page 4 Mr. Ingram suggested the sign he located on the comer of 15th and South A Street to avoid the sign from being blocked by the man lifts and the trees, Mr. Bocci said that if the sign were to be placed on the corner, the Joey's Pizza sign would block the view of the sign. Mr. Bocci added that if the variance is approved. he will not allow the rental equipment on the property to block the new freestanding sign. Mr. Miller moved to approve the variance as requested, Mr. Tharp seconded the motion. The motion passed unanimously. 3. Business from the Board: 4, Business from the Staff: None. a. Change in ~ivision Responsibilities. Mr. Puent announced to the Board that the Building Safety Section of the Community Services ~ivision has gone through a small reorganization. He said that Lisa Hopper has recently received a promotion and will be overseeing the penn it and inspection services for the Division. b. Annual Contractor Meeting. Me. Puent said that although the tumout was small, the annual meeting was very infonnative. The contractors made very good suggestions on improving some of our policies and fonns. He added that the suggestions made will be implemented by January I, 1997. Chairperson Baird suggested that two annual contractor meetings be held, one for residential contractors and one for commercial/industrial contractors. Mr. Puent said that if in the future we can obtain a larger attendance to these meetings, dividing the meetings into the two types of construction would be very beneficial to both those in attendance and staff. c, Sign Code Update. Ms. Hopper told thc Board that she will be having a meeting for interested sign contractors on July 23rd at 9:00 a.m. to discuss the proposed changes to the Sign Code and invited the Board to attend. 5. Mr. O'Connor reaffinned Ms. Hoppers comments relative to the agreement the Mall Partnership would like to enter into with the City of Springfield for the "exchange" of one freestanding sign for another. He added that in addition to not allowing an additional freestanding sign for the business who will be locating on the pad site, the Mall Partnership will also remove the entrance monument sign.as stated earlier by Ms, Hopper. Mr. O'Connor said that the new retail store which is under construction at this time has visibility from 1-5, but there is no visibility from the entrance on Gateway Street. He added that the proposed sign will be 20 feet high and meet all required setbacks. Chairperson Baird closed the public hearing. Mr. Ingram reaffirmed with Mr. Atkinson that the existing monument sign will be removed if this variance is approved. Mr. Atkinson said that was correct. Mr. Tharp moved to approve the applicants request. Mr. Ingram seeonded the motion. Chairperson Baird asked Mr. O'Connor if directions to the site will be placed on the proposed sign. Mr. O'Connor said there will be no direction given on the proposed sign, however. the Mall Partnership is working on directories to be placed on the mall property. Mr. Atkinson added that once a customer has turned off Gateway Street onto the mall property, the retail store will be visible. Chairperson Baird called for the vote. The motion passed by a vote of 3 to I with Chairperson Baird voting in opposition. Mr. Atkinson asked the Board if they would discuss the possibility ofa change to a previous variance approval from the Board for a four foot sign band at the Gateway Mall. Mr. Atkinson said that the Emporium wishes to place a sign within the approved four foot band. but the "E" in Emporium is six feet tall.
