A RESOLUTION ESTABLISHING AN APPLICATION FEE FOR
CLAIMS RELATED TO REGULATORY TAKINGS ARISING UNDER
THE 2000 AMENDMENT TO ARTICLE I, SECTION 18 OF THE
OREGON CONSTITUTION (BALLOT MEASURE 7)
WHEREAS, at the General Election held on November 7, 2000, the voters of
the state of Oregon enacted Ballot Measure 7 which added provisions to
Article I, section 18 of the Oregon Constitution; and
WHEREAS, the aforesaid Measure 7 provides for the compensation of property
owners in certain circumstances where City regulations reduced their
property values; and
WHEREAS, the aforesaid Measure 7 contains no prov~s~on explaining how
claims for compensation will be processed, what information must be
provided to the City so the claim may be properly evaluated, and what
procedure should be provided for the determination of the entitlement to
such compensation, and as a consequence the City Council has by Ordinance
provided a process for claims related to regulatory takings arising under
the 2000 Amendment to Article I, Section 18 of the Oregon Constitution
(Ballot Measure 7) and adding Chapter 2 "Government and Administration" of
the Springfield Municipal Code, Sections 2.900 et. seq. "Regulatory
Takings"; and

WHEREAS, Section 2.940 of the Springfield Municipal Code provides that the
application claim for compensation made pursuant to Ballot Measure 7 shall
include an application fee in an amount established by separate resolution
of the Common Council, to at least partially cover the City's cost of
processing the application.
WHEREAS, the Common Council finds it appropriate to establish a fee
reasonably calculated to cover the actual cost of administering each claim
for compensation; and
NOW THEREFORE BASED ON THE FOREGOING FINDINGS IT IS HEREBY RESOLVED AND
ORDERED AS FOLLOWS:
The application fee specified in Springfield Municipal Code Section
2.940 for a claim related to regulatory takings under the 2000
Amendment to Article I, section 18 of the Oregon Constitution shall
be $850, and $100 for notification and publication costs.
