RESOLUTION NO. 00-47
A RESOLUTION AUTHORIZING THE PUBLIC WORKS DIRECTOR, THE CITY
ENGINEER AND THE CITY SURVEYOR TO EXECUTE IMPROVEMENT AGREEMENTS
ON BEHALF OF THE CITY OF SPRINGFIELD AND TO SATISFY AND RELEASE
IMPROVEMENT AGREEMENTS ON BEHALF OF THE CITY OF SPRINGFIELD
WHEREAS, Article 10 ~ 10.030(2) (v)of the Springfield Development
Code provides that a criterion for evaluation of a discretionary
use proposal is that "proposed on-site and off-site public
improvements are sufficient to accommodate the proposed
development"; and
WHEREAS, the City of Springfield may condition the approval of
the discretionary use proposal by imposition of a requirement to
construct on-site and off-site public improvements sufficient to
accommodate the proposed development; and
WHEREAS, an Improvement Agreement is a written agreement,
executed by the property owner in consideration for the City
deferring the construction of certain public improvements; and
WHEREAS, the City of Springfield Public Works Director, City
Engineer and City Surveyor are responsible for the preparation
and review of improvement agreements for City public improvement
projects; and
WHEREAS, the Public Works Director, City Engineer and City
Surveyor are responsible for assuring that in the event
construction of public improvements is deferred, that an
Improvement Agreement is entered into by and between the property
owner and the City of Springfield; and
WHEREAS, the Public Works Director, City Engineer and City
Surveyor are responsible for assuring that in the event an
Improvement Agreement is entered into and public improvements are
subsequently constructed in accordance with the Improvement
Agreement, that such Improvement Agreement be satisfied or
released; and
WHEREAS, Common Council of the City of Springfield wishes to
authorize the Public Works Director, City Engineer and City
Surveyor to execute Improvement Agreements and to satisfy or
release Improvement Agreements on behalf of the City of
Springfield.
NOW THEREFORE IT IS HEREBY RESOLVED AND ORDERED AS FOLLOWS:

The City of Springfield Public Works Director, City engineer
and City Surveyor are each hereby authorized to execute
Improvement Agreements including but not limited to
"Improvement Agreement", "Improvement Agreement and
Application for Sewer Hookup", and other similar Improvement
Agreements intended to defer the construction of public
improvements.
2. The City of Springfield Public Works Director, City Engineer
and City Surveyor are each hereby authorized to satisfy or
release Improvement Agreements and other similar Improvement
Agreements in the event it is determined that construction
of public improvements required by such Improvement
Agreement has occurred.
