RESOLUTIONNO 00-12 A RESOLUTION INITIATING ANNEXATION OF CERTAIN TERRITORIES TO THE CITY OF SPRINGFIELD AND REQUESTING THAT THE LANE COUNTY LOCAL GOVERNMENT BOUNDARY COMMISSION APPROVE THE ANNEXATION. WHEREAS, the City Council is authorized by ORS 199.490(2)(a)(B) to initiate annexation upon receiving consent in writing from a majority of the electors registered in the territory proposed to be annexed and written consent from owners of more than half the land in the territory proposed to be annexed; and, WHEREAS, the property is vacant; and, WHEREAS, there were no electors and the property owners of the territory proposed to be annexed signed a consent to annex (Exhibit 1); and, WHEREAS, that portion of 47th Street extending north from Jasper Road to the north boundary line of the territory proposed to be annexed will be fully improved with the development of the concurrent subdivision and is included in this annexation request; and, WHEREAS, that portion of Jasper Road south of the territory proposed to be annexed is not being annexed at this time because it is a state highway and not currently constructed to city street standards; and , WHEREAS, the territory proposed to be annexed is within the Eugene-Springfield Urban Growth Boundary, is contiguous to the city limits and can be provided immediately with a full range of urban services. NOW THEREFORE THE CITY OF SPRINGFIELD DOES RESOLVE AS FOLLOWS: Section 1: The Common Council of the City of Springfield does hereby recommend approval of the annexation of the subject territory to the City by the Lane County Local Government Boundary Commission, Lane County, Oregon, said territory being described as follows: Township 18 South, Range 2 West, Section 05, Map 12, Tax Lot 9009, excluding the southerly one acre, and including portions of South 47th Street right-of-way; as more particularly described in Exhibit 2 of this Resolution. The annexation constitutes a minor boundary change under the Boundary Commission Act and should therefore be considered by the Boundary Commission, and after study, a Final Order should be entered by the Boundary Commission. Informational Attachment For: Proposed annexation of property located in Springfield, north of JasperRoad, west of 4ih Street; Lane County Tax Assessor's Map 18-02-05-12, Tax Lot 9009 and a portion of South 47th Street and Jasper Road rights-of-way. City Journal Number 1999- 09-0225 and associated Subdivision Approval 1999-09-248. URBAN GROWTH BOUNDARY The City of Springfield's UGB is located approximately 800 feet south of the subject site and is not a substantive issue for this annexation. The subject site is contiguous to the existing city limits along north property line and adjacent 47th Street right of way. URBAN SERVICES All of the utility providers and affected agencies listed below were notified of the development proposal during the Development Review Committee process for the Tentative Subdivision Application for this site. Sanitary Sewer: An 8- inch sanitary sewer line is in place at north property line to serve 16 lots at the annexation area. The lateral extends from an 8 -inch line in Holly Street. Springfield Public Works engineers have determined the line has adequate capacity to serve the site. . Solid Waste Management: Private firms collect and transport solid waste to the Lane County landfill. Water Service: Water is available to serve this site from a 6 -inch water line in 4ih Street. Springfield Utility Board will be the utility provider and has submitted comments supporting the proposed annexation. Fire and Emergency Medical Services: Springfield Fire and Life Safety will provide fire and emergency medical services upon annexation. Police Protection: The Springfield Police Department will provide police protection to this area upon annexation. Parks and Recreation: Willamalane Parks and Recreation District will provide recreational facilities for this area. . Electric Service: Electrical service' is available from SUB Electric services extended to the property's north boundary. Springfield Utility Board will be the utility provider (Metro Plan, Growth Management and the Urban Service Area, Policy 16, page II-B-6). 2-4 . . . Land Use Controls: Springfield DevelopmentServices Department will provide planning and land use control for the site after annexation. , Communication Facilities: US West will provide communication service to the annexation area. Public Schools: School District 19will provide public education facilities for the area. The City sent Steve Barrett, Assistant Superintendent of Operations for the Springfield School District, a notice of the proposed development for this site. The City received no comments. Paved Streets: The proposed subdivision will have primary access off of 4th Street. The developer has been required to improve South 4th Street to City standards along the frontage of the property. City standards for the street adjacent to the site include 2 paved travel lanes, curbs, gutter, sidewalks, street trees and streetlights. Improvements will also be required for a portion of the intersection of 4th Street and Jasper Road to accommodate the increased traffic from the development. Japer Road is a State highway along the south frontage of the property and is paved but not improved to full urban standards, therefore it will not be annexed at this time. Stormwater Runoff: . Springfield Public Works staff has required pretreatment features that may include on- site detention of stormwater with overflow leading into the public line on the northern end of the property. Other Issues: · The annexation/development area has been reduced by one acre from initial submittals due to Public Works review of surrounding utilities. Based upon available capacity and topography of the site, the southerly portion of the subject site will not be approved for annexation and development until sewer facilities and street improvements are constructed in the Jasper Road right of way. · A "clipped corner" dedication of right of way has been initiated with the Public Works Division and is reflected in the annexation. The dedication is to allow ADA side walk improvements at the intersection of 47th Street and Jasper Road. The dedication will be finalized with the City after the annexation is complete. 2-5
