HomeMy WebLinkAboutResolution 00-29 05/01/2000 . . . .', CITY OF SPRINGFIELD, OREGON RESOLUTION NO. 00-29 WHEREAS, the Common Council of the City of Springfield has authorized the Civil Enforcement of Code Violations of the Springfield Municipal Code ~5.622. WHEREAS, on October 14, 1998 Larry Knox, the owner of real property on which nuisance violations were found to exist, pleaded guilty in Springfield Municipal Court to forty-five (45) violations of the Springfield Municipal Code and Springfield Development Code and consented to the assessment of a forfeiture of $100 for each admitted violation plus interest at 9% per annum until paid, and judgment of guilty was entered in the case numbers listed on Exhibit "A" attached hereto and incorporated herein! WHEREAS, the Municipal Court entered Judgments and assessed a forfeiture of $100 for each case number listed on attached Exhibit "A;" WHEREAS, pursuant to Springfield Municipal Code ~5.622(3) delinquent forfeiture assessed for infractions which occurred on real property or for improper use of real property constitute a lien against the real property; WHEREAS, the assessed forfeiture is delinquent and no payment has been made on the obligation; WHEREAS, the real property on which the violations occurred is more particularly described on Exhibit "B" attached hereto and incorporated herein; WHEREAS, the property owner has been notified concerning the proposed lien on the property described on the attached Exhibit "B;" WHEREAS, a public hearing was held by the Common Council of the City of Springfield on May 1, 2000 giving said property owner an opportunity to object to the proposed assessment lien; WHEREAS, it is the intention of the Common Council of the City of Springfield to place a lien on the property so described under the authority of the Springfield Municipal Code ~5.622(3). NOW THEREFORE BE IT RESOLVED, that the Finance Director of the City of Springfield should be, and is hereby directed to, add to the lien docket the proposed lien upon the property described on the attached Exhibit "BOO which is owned by the Defendant who pleaded guilty to the nuisance violations described on Exhibit "A."
